Former IAS officer Parampal Kaur, who contested the Bathinda Lok Sabha seat on a BJP ticket, has approached the Chandigarh Bench of the Central Administrative Tribunal (CAT), seeking permission to withdraw her resignation dated May 9, 2024. She is urging the tribunal to treat her as having voluntarily retired as of April 10, 2024, and grant all associated benefits.
In her application, filed through advocate GS Patwalia, Kaur alleged that her resignation was submitted under pressure from the Punjab Government, which had withheld her No Objection Certificate (NOC) and no dues certificate, even after her voluntary retirement request was approved by the Union Ministry of Home Affairs on April 10.
Kaur, who previously served as Managing Director of the Punjab State Industrial Development Corporation, cited personal and domestic reasons for her decision to retire from the Indian Administrative Service (IAS). When the Punjab Department of Personnel failed to process her voluntary retirement request, she escalated the matter to the Ministry of Home Affairs, the cadre-controlling authority, which subsequently accepted her application.
However, she faced hurdles in obtaining the mandatory no dues certificate/NOC for government accommodation allotted to her in 2016 while serving as Additional Deputy Commissioner of Bathinda. The refusal to issue these certificates, based on a May 8, 2024 order, allegedly forced her to resign from the IAS to contest the elections.
In her plea to CAT, Parampal Kaur asserted her constitutional right to participate in electoral politics and requested the tribunal’s intervention to restore her status as a voluntarily retired officer and secure her consequential benefits.
The case highlights the complexities faced by bureaucrats transitioning to political roles, amid allegations of administrative hurdles and state-level pressures.
