New Delhi: The Supreme Court Bar Association (SCBA) has strongly opposed the recent notification issued by the Lieutenant Governor (LG) of Delhi on August 13, 2025, which permits police officials to record their evidence at police stations. The SCBA has described this move as “arbitrary, unlawful, and against the principles of natural justice,” raising serious concerns about its impact on judicial independence and the fairness of the justice system.
SCBA Highlights Threat to Judicial Independence
In a resolution dated August 22, 2025, the SCBA’s President and Executive Committee highlighted the gravity of the issue, emphasizing that the notification undermines the sanctity of judicial proceedings. The association condemned the notification, stating that it compromises the judicial process and disturbs the delicate balance between the judiciary and the administration.
Call for Immediate Withdrawal of Notification
“The SCBA firmly believes that such a notification gravely affects the independence of the judiciary and the fair administration of justice, besides being against the larger public interest,” the resolution stated. The SCBA has called for the immediate withdrawal of the notification, urging authorities to reconsider the decision in the interest of justice and upholding the rule of law. Pragya Baghel, Honorary Secretary of the Supreme Court Bar Association, formally signed the resolution on behalf of the Executive Committee.
Concerns Over Impartiality and Public Trust
This notification has sparked widespread concern among legal professionals who warn that allowing police officers to depose from police stations could jeopardize the impartiality of trials and public trust in the judicial process. The SCBA’s strong condemnation underscores the ongoing challenges in maintaining judicial autonomy and ensuring fair administration of justice in India.
