Kolkata: The Calcutta High Court on Tuesday dismissed a public interest litigation (PIL) challenging the Election Commission’s transfer of key administrative and police officers in West Bengal ahead of the upcoming assembly elections.
The PIL sought to quash the EC’s orders transferring several senior officials, including the state’s Chief Secretary, Home Secretary, and Director General of Police (DGP), immediately after the announcement of the poll schedule. The petitioner argued that such large-scale transfers could disrupt the functioning of the state administration.
Division Bench Upholds EC Authority
A division bench of the Calcutta High Court, presided over by Chief Justice Sujoy Paul, rejected the petition. The bench upheld the Election Commission’s authority to transfer officials to ensure a fair and impartial conduct of elections, emphasizing that such measures are fully within the EC’s constitutional mandate.
West Bengal Assembly Elections: Schedule and Context
The West Bengal assembly elections are scheduled in two phases, on April 23 and April 29, for the 294-member assembly, with vote counting on May 4.
The EC’s transfers form part of its routine administrative oversight, aimed at maintaining neutrality and transparency in poll-bound states.

Earlier this month, the EC issued a notification detailing transfers and new postings for key officers to ensure smooth election conduct:

• Kumar Sunny Raj (IPS 2017) – SP, Birbhum
• Ishani Paul (IPS 2013) – SP, Islampur PD
• Pushpa (IPS 2012) – SP, Hooghly Rural
• Jaspreet Singh (IPS 2016) – SP, Diamond Harbour PD
• Yeilwad Shrikant Jagannathrao (IPS 2015) – DC, Central Division, Kolkata
• Papiya Sultana (SPS 2015) – SP, Paschim Medinipur
Additionally, the EC appointed Siddh Nath Gupta as the new Director General of Police, replacing Peeyush Pandey.
These transfers and postings are intended to ensure efficient management of polling operations and maintain administrative neutrality during the elections.
