New Delhi: The central government has formally re-appointed Justice Ashok Bhushan as the Chairperson of the National Company Law Appellate Tribunal (NCLAT). The tenure extension will run until he attains the age of 70, i.e., 4 July 2026, marking a significant step in maintaining consistency at one of India’s key corporate law adjudicatory bodies.
Background of the Story
NCLAT is a critical tribunal created under the Companies Act 2013, vested with appellate jurisdiction over decisions of the National Company Law Tribunal (NCLT), the Insolvency and Bankruptcy Board of India, Competition Commission of India and other regulatory authorities.
Justice Bhushan had first joined NCLAT as Chairperson on 8 November 2021 after his retirement from the Supreme Court on 4 July 2021.
Details of the Re-appointment
On 7 November 2025, the Ministry of Personnel, Public Grievances & Pensions issued an order approving the appointment of Justice Bhushan to continue as Chairperson of NCLAT until 4 July 2026.
The approval came via the Appointments Committee of the Cabinet, based on the proposal from the Ministry of Corporate Affairs.
With this extension, Justice Bhushan will continue leading the tribunal during a key phase of corporate dispute resolution and insolvency regime enforcement.
Who is Justice Ashok Bhushan?
- Born on 5 July 1956 in Jaunpur district, Uttar Pradesh.
- He completed his Arts degree in 1975 and his law degree (First Division) from Allahabad University in 1979.
- Enrolled as an advocate with the Bar Council of Uttar Pradesh on 6 April 1979, practising on the civil and original side in the Allahabad High Court.
- Served as Standing Counsel for Allahabad University, State Mineral Development Corporation Ltd, various municipal bodies, banks and educational institutions.
- Elevated as a permanent Judge of the Allahabad High Court on 24 April 2001.
- Moved to the Kerala High Court on 10 July 2014 as Judge, became Acting Chief Justice on 1 August 2014, and was sworn in as Chief Justice on 26 March 2015.
- Elevated to the Supreme Court of India on 13 May 2016; retired on 4 July 2021.
- Has been Chairperson of NCLAT since 8 November 2021 and now re-appointed till July 2026.
