Chennai: Retired Indian Police Service officer G. Sampath Kumar has filed a fresh appeal before the Madras High Court, challenging the appointment of an advocate commissioner to record cricketing legend MS Dhoni’s evidence in an 11-year-old defamation case. The move has reignited debates about equality before law and special treatment for celebrities in judicial proceedings.
Latest Development in Decade-Old MS Dhoni Defamation Case
The former IPS officer has strongly opposed the August 11, 2025 order by Justice C.V. Karthikeyan allowed an advocate commissioner to record Dhoni’s testimony at a location convenient to the cricketer, rather than requiring his personal appearance at the Madras High Court.
Kumar argued before the Division Bench of Justices S.M. Subramaniam and Mohammed Shaffiq that ” all litigants must be treated equally and no privilege or priority must be given to the celebrities.”
Background of the High-Profile Case
The MS Dhoni defamation case dates back to 2014 when Dhoni filed a ₹100 crore lawsuit against Zee Media Corporation, journalist Sudhir Chaudhary, G. Sampath Kumar, and News Nation Network for allegedly linking his name to the 2013 IPL betting and match-fixing scandal.
At the time, Dhoni was captaining Chennai Super Kings, which faced a two-year suspension from the IPL following the scandal involving CSK owner N. Srinivasan’s son-in-law, Gurunath Meiyappan.
Court Directs Withdrawal of Offensive Remarks
During the hearing, senior counsel P.R. Raman, representing Dhoni, raised serious objections to ” highly offensive” remarks made by Sampath Kumar against the judiciary in his written submissions.

Taking cognizance of these concerns, the Division Bench directed Kumar’s counsel to file an affidavit withdrawing those remarks. The court then adjourned the matter to November 4, 2025.
The 2013 IPL Investigation: How It All Began
Sampath Kumar, who was serving as Superintendent of Police in the Q Branch CID (Internal Security) in 2013, stumbled upon a cricket betting network while investigating a fake passport case.
According to his submissions, his team uncovered a network of bookies operating in Chennai and interrogated a kingpin who allegedly exposed the entire match-fixing process.
Kumar claimed he was deposed before the Justice Mudgal Committee, which was established by the Supreme Court to probe the 2013 IPL betting scandal. However, a television journalist subsequently conducted a sting operation on him, recording their conversation about the betting case, which was telecast on February 23, 2014.
Suspension and Subsequent Legal Battles
Following the telecast, Sampath Kumar was immediately placed under suspension for interacting with the media. In 2014, he was also accused of taking bribes from bookies to remove their names from the case. However, he was exonerated in departmental proceedings in 2019 due to lack of evidence.
MS Dhoni Defamation Case: Contempt of Court Conviction
The legal complications intensified when Dhoni filed a contempt petition against Sampath Kumar for making disparaging remarks against the Supreme Court and Madras High Court in his court submissions.
In December 2023, the Madras High Court sentenced Kumar to 15 days simple imprisonment for criminal contempt. The Division Bench of Justices S.S. Sundar and Sunder Mohan found that Kumar had ” consciously made an attempt to scandalise and to lower the authority” of the courts.
The sentence was suspended for 30 days to allow Kumar to appeal. Subsequently, in February 2024, the Supreme Court stayed the 15-day jail term pending the appeal.

– Whether defendants deliberately carried out a defamation campaign
– Whether actions caused mental agony to the plaintiff
– Whether news channels can publish reports beyond exact judicial orders

Legal Experts’ Perspective on MS Dhoni Defamation Case
Legal experts note that this case raises important questions about procedural equality in courtrooms. While courts have discretion to make special arrangements for witnesses, such decisions must balance convenience with the fundamental principle of equality before law.
