Chandigarh: In a significant decision that reasserts the hierarchy in police administration, the Punjab and Haryana High Court has ruled that the Haryana Home Department and its Secretary have overriding authority over the Director General of Police (DGP) and subordinate police officers in all disciplinary matters.
The ruling was delivered on September 23, 2025, as the Court quashed an order issued by a Superintendent of Police (SP) that sought to override a prior decision made by the Home Department.
SPs Must Abide by Home Secretary’s Orders: High Court
The Court clearly stated that Superintendents of Police (SPs) and other police officials are “bound to follow and honour the orders of the Home Secretary” and have no legal authority to disregard or countermand the directions issued by the Home Department.
This clarification came while the Court examined the legal validity of a disciplinary notice dated August 7, 2025, issued by an SP, which had effectively attempted to set aside a direction of the Home Department.
Key Issue: Who Holds Final Disciplinary Authority?
At the heart of the matter was a fundamental question: Who has the final say in disciplinary proceedings against police officers under Haryana’s service rules?
In its detailed ruling, the Court found that the Home Department, as an arm of the State Government, has long exercised statutory authority to review, modify, confirm, or annul punishments imposed by the DGP or other police authorities.
State Government’s Role Clearly Defined Under Law
The Court’s ruling was further supported by an affidavit submitted by Dr. Sumita Misra, Additional Chief Secretary (Home), Haryana, who clarified the legal provisions governing such authority.
“A plain reading of the statutory provision would show that the State Government has been conferred the power to call for the records, to review the award, to confirm, enhance, modify, or annul the same,” Dr. Misra stated in her affidavit.
This aligns with longstanding administrative practice, where the Home Department acts as the final disciplinary authority for police officers under its jurisdiction.

The High Court’s ruling not only resolves the immediate conflict but also reasserts the institutional hierarchy in matters of police discipline in Haryana.
The verdict ensures that individual police officers or even the DGP cannot act in isolation when it comes to matters already addressed by the Home Department. It also reinforces the primacy of civil authority over police departments in a democratic framework.
