SC Warns Govt: Ensure Dignity, Infrastructure for Retired Judges in Tribunals or Abolish Them

New Delhi: The Supreme Court has sharply criticized the government for failing to provide basic facilities to retired judges appointed in tribunals. A Bench of Justices B.V. Nagarathna and R. Mahadevan warned that if dignity and infrastructure cannot be ensured, tribunals should be abolished and cases transferred back to the high courts.

Court Flags Inadequate Facilities

The judges noted that many retired judges, including former Chief Justices, decline tribunal posts after learning about the lack of resources. Those who accept positions are often forced to request even basic items such as accommodation, vehicles, and stationery.

The Bench highlighted that tribunal chairpersons, often former Chief Justices or Supreme Court judges, are left without dignity in their roles. It remarked that some are even provided with “the most rickety car” for official work.

Government Criticised for Neglect

Addressing ASG Vikramjit Banerjee, the Court faulted the government for failing to allocate funds and infrastructure. It observed that although Parliament passes laws creating tribunals, no provisions are made for judicial impact or expenditure.

The Bench urged that a committee of ministries, including the Department of Personnel and Training, should be formed to design a uniform framework for tribunal infrastructure. It stressed that retired judges must be treated with dignity to ensure the system functions effectively.

Vacancies and Petitioner’s Plea

The matter stemmed from a petition filed by the NGT Bar Association, Western Zone, highlighting prolonged tribunal vacancies. The Centre admitted that two retired judges recently declined appointments due to inadequate facilities, forcing the process to restart.

While disapproving of such refusals, the Court acknowledged the judges’ reasons. However, it rejected the petitioner’s request to allow existing tribunal members to continue beyond their tenure until replacements are appointed. The case will now be heard again on December 16.
