Srinagar: The District Court in Srinagar on Saturday granted interim bail to Vivek Batra, a former Indian Revenue Service (IRS) officer of 1992 batch, in a high-profile case involving allegations of assault, attempted rape, and criminal intimidation against an elderly Kashmiri Pandit couple.
Background of the Case
Batra was arrested on January 8, 2026, following a complaint lodged at Rajbagh Police Station. According to FIR No. 01/2026, the complainant, Ashok Toshkhanai, alleged that Batra, along with several associates, forcibly entered his residence armed with iron rods and hammers, assaulted family members, and attempted to set the house ablaze.
The FIR triggered a swift investigation, with custodial interrogation and collection of evidence largely completed before the bail hearing.
Court Observations and Bail Decision
While granting interim bail, the court observed that the allegations would be thoroughly examined during the trial, but at this stage, the accused should not remain in prolonged pre-trial detention.
Rejecting the prosecution’s argument that Batra should have first approached a lower court, the judge clarified that the Sessions Court has independent powers under Section 483 of the Bharatiya Nagarik Suraksha Sanhita (BNSS) to grant bail.
The court emphasised the presumption of innocence and the constitutional guarantee of personal liberty, noting that the accused is entitled to defend himself while the investigation proceeds.
Legal Representation
Batra was represented by Advocate Vikas Malik as the lead counsel, assisted by Advocate Mushtaq Dar. Malik argued that the FIR was “false and fabricated” and stressed that Batra was willing to fully cooperate with the investigation.
The prosecution was represented by the Public Prosecutor on behalf of the State.
Conditions and Next Steps
Batra was released on interim bail on Saturday evening after fulfilling court-mandated conditions. The investigation remains ongoing, and the case is currently sub judice.
A trial will determine the guilt or innocence of the accused based on evidence, witness testimonies, and legal arguments.
