Chandigarh: The Haryana government has appointed retired Indian Revenue Service (IRS) officer Devinder Singh Kalyan as the new State Election Commissioner. This follows a recommendation by the state cabinet and an official order from the Governor. Kalyan retired from service on May 31.
So far, the post was mostly held by retired IAS officers. His appointment breaks that tradition, making him the first IRS officer in this role.
Family Ties to Speaker Spark Backlash
Kalyan is the brother of Harvinder Kalyan, who serves as Haryana Assembly Speaker and is also a BJP MLA from Gharaunda. Due to this close family link, many have raised concerns over a conflict of interest. Critics believe that such ties may impact the commission’s impartiality.
Legal Experts Raise Concern
Former Haryana Advocate General Mohan Jain strongly criticized the appointment. He said the SEC must remain neutral, especially during elections. According to him, appointing someone related to a senior ruling party leader could weaken trust in the electoral system.
Earlier Nomination for SEIAA Rejected
In 2023, Kalyan was working as Principal Secretary in the Excise and Taxation Department. Earlier, he served as an advisor in the Finance Department. During that time, he was nominated for the post of Chairman of the State Environment Impact Assessment Authority (SEIAA).
However, the Union Environment Ministry rejected his name. He did not meet the eligibility conditions listed in the Environment Impact Assessment Notification, 2006.
Constitutional Mandate and Public Expectation
Under Articles 243K and 243ZA of the Indian Constitution, the State Election Commission is in charge of electoral rolls and elections to panchayats and municipal bodies. With elections approaching, many fear the new appointment could hurt public confidence.
They believe that only a non-partisan officer should lead the SEC. Transparency and fairness are key in maintaining a strong democratic process.
