Prakash, who previously served as CEO of Invest UP and Secretary of Industrial Development, was suspended on March 20, 2025, after being accused of demanding a 5% commission (around ₹1 crore) from a solar company to approve a project.

1. Quashing of Chargesheet
In February 2026, the Lucknow bench of the Allahabad High Court quashed the chargesheet filed against Prakash, citing lack of concrete evidence to substantiate the allegations.

2. Retraction by Complainant
The businessman who initially filed the complaint retracted his statement, stating that the allegations were a result of a misunderstanding.

3. Court Observations
The High Court observed that the charges did not constitute an actionable offence under the Bharatiya Nyaya Sanhita (BNS) or the Prevention of Corruption Act.

4. Procedural Requirements
Under service rules, the state must review any suspension before it completes one year. Since Prakash’s suspension began on March 20, 2025, the government moved to reinstate him before the March 2026 deadline.

Following the court verdict, the state government is preparing a report for the Ministry of Personnel, Public Grievances and Pensions to formalize his return. Abhishek Prakash was accused of demanding a commission via an intermediary from SAEL Solar P6 Private Limited in exchange for project approvals.
