Guwahati/Itanagar: The Gauhati High Court has overturned a lower court’s decision to grant bail to Arunachal Pradesh IAS officer Talo Potom, who faces allegations of abetment to suicide in the case of a 19-year-old’s death in 2025.
Justice Yarenjungla Longkumer of the High Court’s Itanagar Bench ordered that Potom be taken into custody immediately, criticizing the District and Sessions Court at Yupia for granting bail “without proper application of mind.”
Background of the Case
The case traces back to 23 October 2025, when the deceased, a 19-year-old, was found dead at his rented accommodation in Papum Pare district.
Suicide notes left by the victim accused Talo Potom and senior engineer Likwang Lowang of sexually exploiting and harassing him over a prolonged period.
The notes cited “prolonged humiliation, coercion, and threats” as reasons behind the extreme step.
FIR lodged by the victim’s father included charges of abetment to suicide, sexual exploitation, mental harassment, and corruption.
Hours after the FIR, Likwang Lowang, an officer in the State Rural Works Department, committed suicide.
High Court’s Observations
Justice Longkumer criticized the trial court for:
- Ignoring crucial materials in the case.
- Recording findings contrary to established legal principles governing bail.
Failing to consider the serious societal impact of the offence, which “shocked the collective conscience of the society.”
The Bench emphasized that while bail cancellation is not routine, it is justified when:
- The order is unjustified or perverse.
- Material facts are ignored or overlooked.
The HC also noted that releasing an influential officer like Potom at an early stage of investigation, despite a prima facie case, could have jeopardized the probe.
Legal Action and Immediate Custody
The victim’s father approached the High Court under Section 483(3) of the Bharatiya Nagarik Suraksha Sanhita to seek cancellation of bail.
Following the HC order, Talo Potom will now be taken into custody, with further investigation and trial proceedings expected to resume promptly.
