In a significant move, the Supreme Court of India on Friday removed controversial remarks made by Justice Prashant Kumar of the Allahabad High Court in a recent matter. The apex court emphasized that High Courts are not ‘separate islands’ and cannot function in isolation from the larger judicial framework.

Chief Justice Holds Sole Authority Over Roster
The Supreme Court bench, while ruling on the matter, reaffirmed the well-established judicial principle that the Chief Justice of a High Court alone holds the authority over the court roster. The apex court directed that all further decisions on the issue be made by the Chief Justice of the Allahabad High Court.
A Call for Judicial Prudence
The Supreme Court issued a strong caution against what it described as “perverse and unjust” orders. It expressed hope that such judicial overreach would not be repeated in future High Court rulings.
The bench underlined that every High Court must act to uphold the rule of law and safeguard institutional integrity. “If law is not preserved and protected in the courtroom itself, it will mark the end of the judicial system in this country,” the bench noted.
Bar Association Welcomes Supreme Court’s Intervention
The Allahabad High Court Bar Association welcomed the Supreme Court’s decision to remove the harsh remarks made by Justice Prashant Kumar.
Bar Association President Mr. Anil Tiwari lauded the move, calling it a “very good step” toward preserving the dignity and integrity of the judiciary.
Misuse of Law in Civil Disputes Addressed
The bench reiterated the legal position in civil disputes, stating that criminal proceedings should not be misused to settle such matters. It clarified that when civil remedies are available, filing criminal complaints is an abuse of the judicial process. Judges are expected to recognize and apply this principle to prevent the misuse of criminal law.
