Ranchi: In a recent judgment, the Jharkhand High court said that authorities must first consider extending the tenure of existing Consumer Grievance Redressal Forum (CGRF) members before issuing fresh recruitment notifications. This decision highlights the importance of fairness, transparency, and institutional independence in bodies that handle public grievances.

Background of CGRF Recruitment Extension Ruling

The case was heard by the Jharkhand High Court while examining a recruitment advertisement issued by Jharkhand Bijli Vitran Nigam Limited (JBVNL) in 2025.

  • The advertisement invited applications for CGRF posts
  • These posts were already occupied by existing members

The court said that before issuing fresh recruitment:

  • They must decide whether their tenure can be extended

The court found that:

  • JBVNL issued a fresh advertisement
  • Without explaining why existing members were not extended

This was considered a misuse of power and a violation of fair process.

3. No Automatic Right to Extension—but Due Process Is Mandatory

The court clarified:

  • Members do not have an automatic right to extension
  • But authorities must follow a proper evaluation process

Skipping this process makes the decision legally weak.

4. Independence of CGRF Must Be Protected

The court emphasized that:

  • CGRFs are quasi-judicial bodies
  • Power companies are often parties in disputes before them
  • If those companies control appointments arbitrarily, neutrality is at risk

The court warned that such actions could damage public trust.

Under JSERC Regulations, 2020:

  • Initial tenure of CGRF members = 3 years
  • Extension allowed = up to 2 additional years
  • Condition = satisfactory performance or age limit (65 years)

This means extension is possible but conditional, not automatic.
