Delhi High Court Suspends Two Officers Over Forum Shopping and Auctioneer Appointment Allegations

The Delhi High Court has suspended Veena Rani and Vinay Singhal over alleged misconduct and ordered disciplinary proceedings.

New Delhi: Delhi High Court suspends two judicial officers after finding prima facie evidence of alleged misconduct. The suspended officers are Veena Rani and Vinay Singhal, both members of the Delhi Higher Judicial Service (DHJS). The High Court has also ordered separate disciplinary proceedings against them. The action follows official administrative decisions and vigilance inquiries. The court clarified that the suspension is part of the disciplinary process and does not mean the officers have been found guilty.

What is the Reason of Delhi High Court Judicial Officer Suspension 

The Delhi High Court suspended Veena Rani and Vinay Singhal after the Full Court found sufficient initial evidence to begin disciplinary proceedings. The allegations against both officers are different. Separate inquiries will now examine each case before any final decision is made.

The suspension orders were issued by the High Court administration in accordance with the applicable service rules.

Who Are the Suspended Judicial Officers

The two suspended officers are:

  • Veena Rani, a Delhi Higher Judicial Service officer.
  • Vinay Singhal, another Delhi Higher Judicial Service officer.

Both officers have been suspended with immediate effect while disciplinary proceedings continue.

Delhi High Court Judicial Officer Suspension: Why Was Veena Rani Suspended

Veena Rani’s suspension is linked to long-pending allegations of forum shopping in intellectual property rights (IPR) cases. Forum shopping refers to an attempt by litigants to have their cases heard before a particular court or judge believed to be more favourable.

The matter first came into focus in 2018 when a Division Bench of the Delhi High Court noticed allegations that some litigants repeatedly filed IPR cases before specific judicial officers.

The Bench directed that such cases should not be listed before the concerned officers until the allegations were examined.

Later, in 2019, a Bench headed by Justice Manmohan asked the High Court Registry to place the matter before the Chief Justice on the administrative side for a detailed inquiry.

Following an internal vigilance investigation, the High Court decided to suspend Veena Rani and begin formal disciplinary proceedings.

Why Was Vinay Singhal Suspended

Vinay Singhal was suspended after a vigilance inquiry into allegations related to the appointment of court auctioneers.

According to the inquiry, the allegations involve irregularities in appointing advocates as court auctioneers and issues connected with payments made during the process.

After reviewing the inquiry report, the Full Court decided that disciplinary proceedings should be initiated and ordered his immediate suspension.

What Happens During the Disciplinary Proceedings

The disciplinary proceedings will independently examine the allegations against both officers. The inquiry will collect evidence, review records, and follow the legal procedure before reaching any conclusion. No final finding has been made against either officer at this stage.

Conditions During Delhi High Court Judicial Officer Suspension 

During the suspension period:

  • Both officers will remain attached to their respective Principal District Judge offices.
  • They cannot leave Delhi without prior permission from the competent authority.
  • They will receive allowances as permitted under the applicable service rules.
  • The disciplinary inquiries will continue until completion.

The Delhi High Court issued the suspension orders under the relevant service rules governing judicial officers. These rules allow an officer to be suspended when disciplinary proceedings are pending or are about to begin.

Suspension is an administrative measure meant to ensure a fair and independent inquiry.

Forum shopping is the practice of trying to file a case before a particular judge or court that is expected to give a favourable decision. Indian courts consider this practice harmful because it can affect fairness and public confidence in the judicial system.

Why Is This Case Important?

The judiciary depends on public trust. By taking action after receiving prima facie evidence, the Delhi High Court has shown that complaints against judicial officers will be examined through proper legal procedures. The court has also made it clear that suspension is not a punishment and does not prove guilt. The final outcome will depend on the findings of the disciplinary inquiries.
