No More Delays! Delhi High Court Pushes Govt for Speedy Court Fee Refund Policy Gives Govt 4-Month Deadline

New Delhi: The Delhi High Court court fee refund policy issue has come into focus after the High Court asked the Delhi government to create a clear system for the speedy return of court fees to litigants.

The Court said people should not face long delays in getting refunds after their disputes are settled. The Bench observed that a proper and codified mechanism would reduce hardship for litigants and improve access to justice.

Delhi High Court Court Fee Refund Policy: What Did the Court Directed?

A Division Bench led by Devendra Kumar Upadhyaya and Tejas Karia directed the Delhi government to frame a policy or guidelines within four months for quick refund of court fees once disputes are resolved between parties.

The Court highlighted that:

  • Litigants often face delays in getting refunds.
  • Court fees should not become a burden after settlement.

The Bench reportedly observed that once a dispute is settled, there is no reason for a litigant to struggle for the return of court fees.

Delhi High Court Court Fee Refund Policy: Existing Legal Position

The refund of court fees is governed under provisions of the Court Fees Act, 1870. Courts have repeatedly supported the idea that litigants who settle disputes should receive refunds without unnecessary hurdles.

Earlier, the Supreme Court had also ruled that parties settling disputes outside court intervention may still be entitled to refund of court fees under Section 89 of the Civil Procedure Code (CPC).

The Delhi High Court had also earlier observed that court fees should not act like a penalty discouraging people from approaching courts.
