The Central Registrar of Cooperative Societies has recently appointed a retired IAS officer, Mr. S.K. Srivastava (1980 batch), as an arbitrator to settle the dispute between Mr. V.V. Pankajakshan Nair and another party, and the National Labor Cooperatives Federation of India Ltd. (NLCF).
Ex-IAS Srivastava has been appointed in accordance with the provisions of the Arbitration & Conciliation Act, 1996, and Section 84 of the Multi-State Cooperative Societies Act, 2002. While releasing the order, the CRCS stated, “It is pointed out that as per sub-section 5 of Section 85 of the MSCS Act, 2002: ‘Save as otherwise provided under this Act, the provisions of the Arbitration and Conciliation Act, 1996 (26 of 1996) shall apply to all arbitration under this Act as if the proceedings for arbitration were referred for settlement or decision under the provisions of the Arbitration & Conciliation Act, 1996.“
The CRSC’s order further read, “The fee and other expenses of the arbitrator shall be governed by the provisions of the Arbitration & Conciliation Act, 1996. The dispute must be settled within the time limit prescribed in the Arbitration & Conciliation Act, 1996.“
Officer Srivastava is the former Chief Secretary of Delhi.
