Shimla: The Himachal Pradesh High Court has expressed strong concerns over the misuse of deputations by government employees in the health and education departments. The bench noted that many employees secure deputations to urban centres, particularly Shimla, while continuing to claim service benefits meant for their original postings in hard, tribal, and rural areas.
The division bench, comprising Chief Justice Gurmeet Singh Sandhawalia and Justice Jiya Lal Bhardwaj, described the trend as “disturbing factors” and emphasised that it undermines the intent of hard-area postings, rendering the purpose of development schemes ineffective.
Details Revealed in Compliance Affidavits
The issue surfaced after compliance affidavits submitted by the Director of Health Services and the Education Secretary revealed:
- 123 employees of the health department
- 86 employees of the education department
These employees were deputed at locations other than their official places of posting.
The court had earlier sought clarification on whether employees could continue to claim transfer benefits based on their original postings despite extended deputations. Supplementary affidavits confirmed that deputation periods are not recorded in the service books for future transfers, raising concerns about policy loopholes and potential misuse.

Court Directs Immediate Policy Intervention
The bench described the situation as a serious issue requiring urgent redressal. It directed the Chief Secretary of Himachal Pradesh to:
- Issue necessary instructions to curb the misuse of deputations
- Implement policy corrections to ensure compliance with the intent of hard-area postings
The High Court underscored that employees’ actions are depriving rural populations of critical services, defeating the purpose of posting officials in difficult regions.
