Can A CRPF Constable Lose Disability Benefits For Not Completing Training? Court Answers

New Delhi: The CRPF disability benefits issue came under focus after the Gauhati High Court ruled that a CRPF constable cannot be denied rehabilitation and disability-related benefits merely because he had not completed basic training or taken the prescribed oath. 

The Division Bench upheld an earlier Single Judge order and dismissed the Union of India’s appeal. The judgment strengthens legal protection for personnel who suffer disabilities while serving in the Central Reserve Police Force (CRPF).

Background Of The Case

The case involved a CRPF constable who was appointed to the force and was undergoing training. During the training period, he suffered a disability that affected his ability to continue normal duties.

Following the incident, his case was placed before the Departmental Rehabilitation Board. However, the Board rejected his rehabilitation request on the ground that he had not completed his basic training.

The authorities also noted that he would not be able to perform strenuous duties and that monetary compensation was not permissible under the applicable rules.

CRPF Disability Benefits Ruling: Single Judge Granted Relief

Aggrieved by the rejection and subsequent termination, the constable approached the Gauhati High Court through a writ petition. The Single Judge ruled in his favour and held that he was a member of the CRPF and therefore entitled to benefits available under the Rehabilitation Scheme and disability pension provisions. The court also found that the termination order was not legally sustainable.

Union Of India Challenged The CRPF Disability Benefits Ruling Decision

The Union of India and CRPF authorities challenged the Single Judge’s decision before the Division Bench. They argued that the respondent was only a trainee at the time of the accident and had not become a full-fledged member of the force.

According to the appellants, he had neither completed training nor taken the oath prescribed under Rule 9 of the CRPF Rules, 1955. The authorities contended that the Rehabilitation Scheme was meant only for members of the force and not for trainees. They further argued that without taking the oath, the respondent had no enforceable right to seek reinstatement or rehabilitation benefits.

Respondent’s Arguments Before The Court

The respondent maintained that he had been formally appointed as a Constable (General Duty) by the Commandant of the 174 Battalion, CRPF. He argued that the appointment order and placement on a definite pay scale made him a member of the force. Therefore, denial of benefits merely because training remained incomplete would be unfair and contrary to law.

Findings Of The Gauhati High Court

The Division Bench observed that the respondent had already been appointed as a Constable (GD) in the CRPF. The court held that the absence of an oath due to incomplete training did not take away his status as a member of the force.

Training Completion Was Not The Deciding Factor

The judges noted that non-completion of training alone could not be used to deny statutory protections and service-related benefits. The court emphasized that the respondent’s appointment remained valid.

No Medical Finding Of Permanent Incapacity

The Bench further observed that no competent authority had declared the respondent permanently unfit for service. Without such a finding, termination from service could not be justified solely on the basis of incomplete training.

Relief Could Be Granted Even Without Specific Challenge

The court also clarified that although the respondent had not specifically challenged the termination order, he had sought reinstatement in service. Therefore, granting appropriate relief and setting aside the termination was legally permissible.

Division Bench Dismisses Appeal

After examining the facts and legal arguments, the Division Bench upheld the Single Judge’s ruling. The court dismissed the appeal filed by the Union of India and confirmed that the respondent was entitled to the protections available under the rehabilitation framework.
