Kerala High Court Orders Urgent Review Of E-Prisons Portal After Bail Delay Cases

The Kerala High Court has raised serious concerns after 341 prisoners who were granted bail were not released within seven days. The Court has ordered an investigation into gaps in the state's e-Prisons portal and directed authorities to improve prisoner tracking systems.

Thiruvananthapuram: The Kerala E-Prisons Portal has come under scrutiny after the Kerala High Court found that 341 prisoners who had been granted bail were not released from jail within seven days of the bail orders. The Court raised concerns over major gaps in the digital prison management system and directed authorities to immediately investigate the issue. 

The case highlights the importance of accurate and timely data sharing between courts, prisons, and government agencies to protect prisoners’ legal rights.

The Kerala High Court noted that 341 prisoners remained in jail even after bail had been granted by courts. The issue came to light after the Kerala State Legal Services Authority (KeLSA) submitted findings regarding discrepancies in the State’s e-Prisons portal, according to court proceedings.

The matter is being examined through a suo motu case focused on prison administration and prisoner welfare.

What Did KeLSA Find

KeLSA informed the Court that as of August 29, bail orders were uploaded on the portal for only a small number of the affected inmates. This created a significant mismatch between actual court orders and the information available in the prison management system.

The Court observed that such gaps could directly affect the monitoring of prisoner status and delay necessary action by prison authorities.

The Bench emphasized that court orders must be available in the system without delay. Judges observed that accurate digital records are essential for tracking inmates and ensuring that legal decisions are implemented promptly.

Court Orders Investigation Into Missing Records

The High Court directed KeLSA to prepare a detailed list of prisoners whose court orders were missing from the portal. The list will be shared with the National Informatics Centre (NIC) and the High Court’s IT Directorate for further examination.

Authorities have been asked to determine whether the problem occurred because orders were never uploaded or because of technical issues during data transmission and synchronization.

The Court instructed the concerned authorities to take immediate steps and submit the required information within a few days. The Bench stressed that delays in addressing the issue could affect prisoners’ legal rights and prison administration.

Additional Problems Found In The E-Prisons Portal

KeLSA informed the Court that the portal showed more than 100 inmates whose bail applications had been rejected. However, corresponding court orders were available in only a limited number of those cases. This raised further concerns about the reliability and completeness of data stored in the system.

Difficulty Tracking Prisoner Status

The Court noted that the existing portal lacks some important features required for effective prison management. Judges pointed out that authorities should be able to identify prisoners who remain in jail because they have not paid fines imposed by courts. The Court directed authorities to create a dedicated feature for tracking such cases.

The High Court also observed that prison authorities currently cannot identify prisoners who have not filed appeals against their convictions. According to the Court, this information is important because legal aid authorities can help eligible inmates pursue available legal remedies. The Court asked the NIC to examine the issue and make the necessary technical changes.

Tracking Prisoners Outside Jail

The Bench further directed that information about prisoners temporarily outside prisons should also be included on the portal. This would cover inmates admitted to hospitals or those moved under official escort arrangements.

Integration Of Court And Prison Systems Underway

The Court was informed that integration of the High Court Case Management System with the police iCOPS platform and the e-Prisons system is currently underway.

Once completed, the integration is expected to improve information sharing among courts, police departments, and prison authorities. The High Court has directed authorities to ensure that the integrated system becomes fully functional within four weeks.
