Supreme Court Grants Regular Bail to Suspended IAS Officer Vinay Kumar Choubey in Hazaribagh Land Scam

The Supreme Court has granted regular bail to suspended IAS officer Vinay Kumar Choubey in a Hazaribagh land scam case, citing completion of investigation, filing of the chargesheet and parity with a co-accused.

New Delhi: The Supreme Court has granted regular bail to suspended IAS officer Vinay Kumar Choubey (1999 batch), a former Deputy Commissioner of Hazaribagh, in a case involving alleged illegal mutation of revenue records and encroachment of government and forest land in Jharkhand.

A Bench comprising Justice Aravind Kumar and Justice Vipul M. Pancholi, on July 31, allowed Choubey’s appeal against the Jharkhand High Court’s refusal to grant him bail.

The Court directed that IAS Choubey be released on regular bail subject to the terms and conditions imposed by the jurisdictional court. It also directed him to remain present before the trial court on every date of hearing unless his personal appearance is specifically exempted.

The relief came primarily on the ground that the investigation had been completed, the chargesheet had been filed and a co-accused had already been granted bail. The Supreme Court held that Choubey was entitled to similar relief on the principle of parity.

Case Relates to Alleged Illegal Land Mutations

The case originates from an FIR registered at the Anti-Corruption Bureau (ACB) Police Station, Hazaribagh, on September 25, 2025.

Choubey has been booked under Sections 420, 467, 468, 471 and 120B of the IPC, along with Section 13(2) read with Section 13(1)(d) of the Prevention of Corruption Act, 1988.

The allegations relate to widespread irregularities in the mutation of revenue records and alleged encroachment of different categories of land in Hazaribagh district.

The land parcels mentioned in the case include Bhudan, forest, government, grazing, Gair Majrua Aam and Gair Majrua Khas land.

According to the prosecution, the investigation revealed irregularities in 33 mutation cases involving land classified as Gair Majrua Khas, which the prosecution claimed constituted forest land.

The allegations further state that revenue officials, allegedly acting in conspiracy with private sellers and purchasers, misused their official positions to facilitate mutations of forest land in violation of applicable laws.

Supreme Court Notes Timeline of Mutations

An important aspect noted by the Supreme Court was the timing of the alleged mutations in relation to Choubey’s tenure as Hazaribagh Deputy Commissioner.

Mr Choubey served as Deputy Commissioner of Hazaribagh from May 26, 2008, to October 5, 2010.

However, the Court noted that 23 of the mutations relied upon by the prosecution were carried out in 2011 and 2012, particularly between October 20, 2011, and March 21, 2012.

The prosecution has alleged that Choubey facilitated or influenced mutation of revenue records in favour of private individuals during his tenure as Deputy Commissioner.

Arrested in November 2025

Mr Choubey was arrested on November 11, 2025, and remained in judicial custody.

The investigation was subsequently completed, with the chargesheet filed on February 5, 2026.

The Supreme Court had earlier granted him interim bail on February 10, 2026.

With the investigation now complete and the chargesheet filed, the Court considered continued custody in light of the fact that a co-accused had already been granted bail.

The principle of parity therefore played a significant role in the Supreme Court’s decision to grant regular bail.

Another Land Case Against the Former Hazaribagh DC

Mr Choubey is also facing another case concerning alleged illegal transactions involving government land during his tenure as Hazaribagh Deputy Commissioner.

In that case, the ACB has alleged that nearly 5,000 acres of land were illegally transacted. The land allegedly included forest land, Gair Majruwa Aam, Sarkari Khas Mahal, Kesher-e-Hind, Lakheraj and Trust land.

The Jharkhand High Court had rejected Choubey’s bail plea in that case on January 6, 2026.

The High Court had observed that there was prima facie sufficient material indicating his alleged involvement in the transactions.

The regular bail granted by the Supreme Court in the present case therefore relates to the specific Hazaribagh land-mutation case and does not amount to a finding on the merits of the allegations against him.

Who Is Vinay Kumar Choubey?

Mr Choubey is a 1999-batch IAS officer of the Jharkhand cadre. Born on October 27, 1975, he holds a B.Tech degree and has served in several senior administrative positions during his career.

His postings have included roles such as Principal Secretary, Secretary to the Chief Minister, Vice Chairman, Managing Director, Chief Executive Officer, State Project Director, Deputy Chairman, Joint Secretary and Administrator.

He has served in several important assignments within the Jharkhand administration and has had a career spanning more than two decades.

Choubey is currently under suspension.

What the Supreme Court Considered

The key factors behind the grant of regular bail were:

  • The investigation had been completed.
  • The chargesheet had already been filed.
  • Choubey had remained in custody after his arrest in November 2025.
  • The Supreme Court had earlier granted him interim bail.
  • A co-accused had already been granted bail.
  • The Court found that Choubey was entitled to relief on the principle of parity.

The Court, however, imposed the usual condition that he must comply with the terms fixed by the jurisdictional court and appear before the trial court unless exempted.
