New Delhi: The Employees’ State Insurance Corporation (ESIC), under the Ministry of Labour and Employment, has extended its New Amnesty Scheme, 2025, until December 31, 2026, giving eligible employers and insured persons an additional three months to settle pending disputes.

The scheme, originally valid from October 1, 2025, to September 30, 2026, has been extended from October 1 to December 31, 2026, on the existing terms and conditions. The decision follows representations from various stakeholders.

What the Amnesty Scheme Offers

The one-time dispute resolution initiative aims to reduce pending court cases and encourage compliance under the erstwhile Employees’ State Insurance (ESI) Act.

Key provisions include:

  • Ad-hoc assessments: Employers can settle assessments by paying actual contributions and interest, without damages.
  • Cases with dues already paid: Cases may be withdrawn upon payment of 10% of the disputed damages.
  • Non-submission of records or delayed payments: Cases filed by ESIC may be withdrawn, with court permission, where the required compliance has subsequently been completed.
  • Eligible cases: Court cases filed on or before March 31, 2025, are covered under the scheme.

Deadline Extended to December 31, 2026

The extension provides eligible employers and insured persons additional time to use the scheme’s dispute resolution provisions. ESIC has encouraged stakeholders to complete the process before the revised deadline.

The initiative is intended to reduce litigation, promote voluntary compliance and support ease of doing business while protecting the rights of people covered by ESIC.
