New Delhi: Delhi high court clarified the Advocate-Client Privilege ruling. The court has held that advocate-client privilege cannot act as an absolute shield when investigating agencies possess prima facie material suggesting that a lawyer may have been involved in activities beyond providing legal advice

The judgment seeks to balance the protection of confidential lawyer-client communications with the need for lawful investigations.

What Did The Delhi High Court Rule

The Delhi High Court dismissed a petition challenging a search conducted by the GST Department at a lawyer’s office.

A Division Bench comprising Justice Anil Kshetarpal and Justice Shail Jain observed that while privileged communications between a lawyer and client remain protected, such protection cannot completely prevent authorities from investigating the lawyer’s own conduct when credible material exists.

The Court stated that advocate-client privilege is an important legal safeguard, but it does not provide blanket immunity from investigation.

Background Of The Advocate-Client Privilege Ruling 

The case arose from an investigation by the Central Goods and Services Tax (CGST) Department into a gaming company, Martkarma Technology Pvt. Ltd. (MPTL).

During the investigation, authorities conducted a search at the office of advocate Puneet Batra and seized computer equipment and documents. The department alleged that the lawyer may have played a role beyond merely providing legal representation.

Challenge Before The High Court

The advocate argued that the search affected materials protected under attorney-client privilege and that authorities could not examine confidential information belonging to clients.

The petitioner contended that there was no justification for searching a lawyer’s office without evidence showing personal involvement in any alleged wrongdoing.

Advocate-client privilege protects confidential communications between a lawyer and a client. The purpose of this protection is to ensure that clients can openly discuss legal matters with their lawyers without fear that those conversations will later be disclosed.

According to the Court, materials relating to a lawyer’s own business activities, transactions, or conduct can be examined during a lawful investigation. Such material cannot be protected solely because it is stored in a lawyer’s office.

The Court made it clear that genuinely privileged communications remain protected by law. The judgment does not permit unrestricted searches of lawyers’ offices or unrestricted access to confidential client information.

Limited Examination Of Seized Data

The Bench directed authorities to use a cloned copy of the seized computer data. It further instructed investigators to confine their examination only to materials relevant to the specific investigation being conducted.
