Moscow: CJI Surya Kant said equal law and equal justice are the true foundation of international law during his keynote address at the 14th St. Petersburg International Legal Forum in Russia. The Chief Justice of India explained that equality is the core principle of justice and should apply equally to every nation and every citizen. He also said that the idea of equality existed in Kautilya’s Arthashastra centuries before the Magna Carta, highlighting India’s ancient contribution to legal philosophy.

Speaking at the plenary session titled “Equal Justice, Equal Law: Access as the Measure of International Law’s Humanity,” he said equality is not a privilege granted by powerful nations but a universal legal principle that strengthens the rule of law.

Why Did CJI Surya Kant Refer to Arthashastra

During his address, CJI Surya Kant said the concept of equality did not begin with England’s Magna Carta of 1215. He explained that Kautilya’s Arthashastra, written in the 4th century BCE, had already established that rulers must follow dharma and the law. According to him, a king who fails to uphold justice loses the moral authority to govern.

This reference highlighted India’s long-standing legal traditions and their relevance in today’s international legal system.

The Chief Justice stressed that equal justice begins with equal access to law. He said legal rights should not remain limited to written laws. Every person must have a fair opportunity to approach courts, receive legal assistance, and obtain justice regardless of income, location, gender, or social background.

CJI Surya Kant highlighted several initiatives taken by the Indian judiciary to improve access to justice, including:

  • Free legal aid for eligible citizens.
  • Public Interest Litigations (PILs) to protect public rights.
  • Simplified judicial procedures that reduce barriers to justice.
  • Constitutional courts that focus on protecting fundamental rights.

He said these reforms have helped make justice more accessible for millions of people across India.

The Chief Justice observed that many countries in the Global South and Global East continue to face challenges such as poverty, institution-building, and the long-term impact of colonialism.

He said international legal standards should be applied fairly and consistently to all nations instead of following unequal standards based on political or economic influence.
