MCD Teacher Recruitment: Why Delhi High Court Denied 10-Year Age Relaxation

New Delhi: The Delhi High Court has ruled that an executive notification granting age relaxation cannot override separate recruitment rules of the Municipal Corporation of Delhi (MCD). The court said that candidates cannot automatically claim age relaxation under a notification issued for a different recruitment system unless the benefit is specifically extended to the relevant post.

The ruling came in a case involving a woman candidate who sought a 10-year age relaxation for the post of Primary Teacher in MCD schools.

MCD Teacher Recruitment: What Did The Delhi High Court Rule

A Division Bench of the Delhi High Court, comprising Justice Anil Kshetarpal and Justice Bharat Parashar, held that separate recruitment rules must be followed when they govern a particular post.

The court explained that an executive notification issued under one set of rules cannot automatically change the recruitment conditions of another autonomous body.

The Bench also upheld the Tribunal’s decision and dismissed the candidate’s writ petition seeking the benefit of age relaxation for MCD teacher recruitment.

Background Of The MCD Teacher Recruitment Case

The case involved Poonam Patwal, a woman candidate who had been working as a Guest Teacher with the Directorate of Education, Government of the National Capital Territory of Delhi, since 2012.

She was born on April 27, 1982, and belonged to the Unreserved category. She applied for the post of Primary Teacher in MCD schools.

The recruitment rules for Primary Teachers in MCD prescribed an upper age limit of 30 years for direct recruitment. However, the candidate relied on a notification dated November 1, 1980, issued under Rule 43 of the Delhi School Education Rules, 1973.

This notification provided a general relaxation of 10 years in the maximum age limit for women candidates applying for various teaching posts covered by the relevant rules.

Why Did The Candidate Seek 10-Year Age Relaxation in MCD Teacher Recruitment

The candidate argued that the 1980 notification was still in force when the recruitment advertisement was issued on June 26, 2018.

She maintained that its later withdrawal on March 6, 2020, could not take away a benefit that she claimed was available when the recruitment process began.

The candidate also argued that she had fulfilled the educational qualifications required for the post and should not be rejected only because of her age. During the selection process, she secured 123.01 marks in the written examination. She was shortlisted for uploading her e-dossier, while the reported cut-off for the Unreserved category was 117.52 marks. She argued that her performance and participation in the recruitment process supported her claim for consideration.

What Happened Before The Delhi High Court

The candidate had approached the Central Administrative Tribunal to seek the benefit of the 10-year age relaxation.

The Tribunal initially allowed her to participate in the selection process. However, it later held that the MCD recruitment was governed by separate recruitment rules.

According to the Tribunal, the 1980 notification could not be used to override the rules applicable to the Primary Teacher post in MCD schools. The candidate challenged the Tribunal’s decision before the Delhi High Court.

MCD Teacher Recruitment: Key Reasons Behind The Court’s Decision

1. MCD Has Its Own Recruitment Rules

The Delhi High Court observed that municipal corporations are autonomous bodies governed by their own legal framework and service conditions.

The MCD has separate recruitment rules for its employees. Therefore, the eligibility conditions for an MCD post must be examined under the rules applicable to that post. The court said that the existence of a notification issued for another regulatory framework does not automatically make it applicable to MCD recruitment.

2. The 1980 Notification Did Not Automatically Apply To MCD Recruitment

The candidate relied on the notification that provided a 10-year age relaxation for women candidates applying for certain teaching posts in Delhi. However, the court found that the candidate had not established that the notification had been adopted by the MCD or incorporated into the recruitment rules governing the Primary Teacher post.

The Bench clarified that an executive instruction cannot automatically override separate recruitment rules simply because both establishments operate within Delhi.

3. The Recruitment Advertisement And Applicable Rules Matter

The court examined the difference between recruitment notices that expressly provide age relaxation and those that do not extend the claimed benefit.

It referred to earlier decisions concerning age relaxation for departmental candidates. In those cases, the relevant recruitment notices specifically included eligible employees of the Government of NCT of Delhi and its local or autonomous bodies.

The Bench explained that those decisions could not automatically establish the candidate’s entitlement in the present case because the applicable recruitment conditions were different.

4. Working As A Guest Teacher Did Not Guarantee Age Relaxation

The candidate also relied on her experience as a Guest Teacher with the Directorate of Education. However, the court said that working with the Directorate of Education did not automatically change her eligibility conditions for a separate post under the MCD.

The recruitment had to be examined under the rules governing the post for which she had applied. The Bench also noted that a relationship between services, including a possible promotional route, does not automatically make them the same service for direct recruitment purposes.

5. The Later Withdrawal Was Not The Main Question

The candidate argued that the 1980 notification remained in force when the recruitment advertisement was issued and was withdrawn only in 2020. The court explained that the central issue was whether the notification applied to MCD recruitment in the first place.

Even if the notification had not been withdrawn when the advertisement was issued, that fact alone could not establish that it overrode the separate MCD recruitment rules.

FAQs

Why Was The 10-Year Age Relaxation Claim Rejected?

The candidate relied on a 1980 notification granting age relaxation to women candidates for certain teaching posts. The court found that she had not established that the notification applied to the separate recruitment rules governing Primary Teachers in MCD schools.

What Did The Delhi High Court Say About Age Relaxation In MCD Recruitment?

The Delhi High Court held that an executive notification granting age relaxation cannot automatically override separate MCD recruitment rules. The benefit must be applicable to the post under the relevant rules or recruitment conditions.

Does The Delhi High Court Judgment Mean MCD Candidates Cannot Get Age Relaxation?

No. The judgment does not prohibit all age relaxation in MCD recruitment. Candidates may receive relaxation where the applicable recruitment rules or advertisement specifically provide for it. Eligibility depends on the rules governing the particular post.
