Ahmedabad: The Gujarat High Court reaffirmed that a Scheduled Tribe woman who legally inherits property can become its absolute owner and has the right to transfer it through a valid Will. 

The court dismissed an appeal challenging the ownership rights of a tribal widow and clarified important principles related to inheritance, tribal customs, and property succession.

The judgment is significant because it strengthens property rights for tribal women and highlights that courts will not assume the existence of a custom unless it is properly pleaded and proved with evidence.

Gujarat High Court Dismisses Appeal Over Tribal Woman Property Rights

The case involved a dispute over agricultural land inherited by a tribal woman named Chhaniben after the death of her husband, Jivlabhai.

According to court records, Jivlabhai died without children. After his death, Chhaniben inherited the agricultural properties, and her name was officially entered into the revenue records. Later, Chhaniben executed a registered Will in favor of the defendant, transferring the property. However, her brother challenged the Will and claimed that he should be declared the sole owner of the property under the doctrine of survivorship.

Background Of The Tribal Woman Property Rights Dispute

The plaintiff argued that since Chhaniben belonged to a Scheduled Tribe community, the provisions of the Hindu Succession Act did not apply to her case.

He further claimed that as Chhaniben died without children, the inherited property should pass to her birth family and not through a Will executed in favor of another person. The plaintiff sought a declaration that the Will was invalid and requested ownership rights over the disputed land.

Trial Court Rejected Plaintiff’s Claim

The Trial Court rejected the plaintiff’s arguments. It held that the plaintiff failed to prove any tribal custom showing that a childless widow’s inherited property must automatically pass to her brother after her death.

The court noted that merely claiming the existence of a custom is not enough. Such customs must be specifically pleaded and supported by evidence.

High Court Examines Tribal Custom And Property Succession

While hearing the appeal, the Gujarat High Court carefully examined whether any established tribal custom existed that restricted Chhaniben from disposing of her property through a Will.

The court observed that no evidence had been produced to prove such a custom within the Chaudhari tribal community. As a result, the court found no legal basis to prevent Chhaniben from exercising ownership rights over the property she had inherited.

Court Recognizes Rights Of Tribal Women

The High Court emphasized that Chhaniben legally inherited the property from her husband. Once she inherited the property, it became her own property for all practical purposes.

The court held that there was no evidence showing she was barred from executing a Will regarding that property.

Court Relies On Principles Of Justice, Equity And Good Conscience

The court observed that the Hindu Succession Act was not directly applicable because the parties belonged to a Scheduled Tribe community. However, in the absence of a proven tribal custom governing the dispute, the court decided the matter using principles of justice, equity, and good conscience.

The judgment noted that Scheduled Tribe women are entitled to inherit property from ancestors who die intestate unless a valid custom provides otherwise.

Validity Of Chhaniben’s Will Upheld

The court found that Chhaniben’s registered Will had already been properly proved before the Trial Court. Because the Will was valid, the defendant legally acquired rights over the property. The court also noted that the defendant’s name had been entered into revenue records without objection after the transfer.
