Big Relief for Women Prisoners: Gujarat High Court Seeks Equal Access to Open Prisons

The Gujarat High Court has asked the State government to ensure women prisoners are not excluded from Open Correctional Institutions and to submit a status report, following the Supreme Court's landmark directions on gender equality in prisons.

Ahmedabad: The Gujarat High Court has orally asked the Gujarat government to ensure that women prisoners are not excluded from Open Correctional Institutions (OCIs). The court also directed the State to submit a status report on the steps being taken. The observation comes after the Supreme Court’s landmark judgment earlier this year that called the exclusion of eligible women prisoners from open prisons unconstitutional and directed all States and Union Territories to make their prison systems more inclusive.

Details of Open Prisons for Women Prisoners

During the hearing on July 31, 2026, the Gujarat High Court orally instructed the State government to take proper measures so that eligible female prisoners are not denied access to Open Correctional Institutions.

The Bench also observed that confidence and awareness should be created among women prisoners so they can choose rehabilitation through open prisons wherever they are eligible. According to reports, the court has asked the State to file a status report detailing the action taken.

What Are Open Correctional Institutions

Open Correctional Institutions, also known as open prisons, are rehabilitation-focused prisons with fewer physical restrictions than traditional jails. Eligible prisoners who have shown good conduct can stay in these institutions under supervision. Many are allowed to work, engage in farming or other occupations, and prepare for reintegration into society while continuing to serve their sentence. The aim is to reduce repeat offences and help prisoners return to normal life.

Supreme Court’s Landmark Directions

In February 2026, the Supreme Court ruled that excluding women prisoners from Open Correctional Institutions amounts to gender discrimination and violates Articles 14, 15 and 21 of the Constitution. The Court directed all States and Union Territories to:

  • Create or expand facilities for eligible women prisoners.
  • Ensure security concerns are not used as a routine reason to deny women access.
  • Develop gender-sensitive systems for transferring eligible women inmates.
  • Review and amend prison rules that directly or indirectly discriminate against women.

The Gujarat High Court’s oral directions are significant because they focus on implementing the Supreme Court’s nationwide guidelines at the State level. By seeking a status report, the High Court is monitoring whether Gujarat is taking concrete steps to provide equal opportunities for eligible women prisoners in rehabilitation programmes and open prisons.
