Jaipur: The Rajasthan advocate enrolment applications issue has received major attention after the Rajasthan High Court directed the Bar Council of Rajasthan (BCR) to clear all pending enrolment applications by September 9, 2026. The Court found that delays caused by the Bar Council’s election process were affecting law graduates waiting to begin their legal careers. 

The order aims to ensure that eligible candidates are not deprived of their right to practice law due to administrative hurdles.

The Rajasthan High Court directed the Bar Council of Rajasthan to process and dispose of all pending advocate enrolment applications within six days.

Justice Shubha Mehta passed the order while hearing a petition filed by law graduate Surendra Khinchi, whose enrolment application had remained pending for several months.

Deadline Fixed For September 9

The Court specifically instructed the Bar Council to complete the enrolment process and inform all concerned candidates by September 9, 2026. The Court observed that unnecessary delays were adversely affecting aspiring advocates and their ability to begin professional practice.

Why Were The Enrolment Applications Delayed

During the hearing, the Bar Council informed the Court that enrolment-related work had not been carried out because of the ongoing Bar Council election process.

Officials stated that no functioning committee was available to process the applications during that period.

Rajasthan Advocate Enrolment Applications Issue: Ad Hoc Committee Was Dissolved

The Bar Council informed the Court that an ad hoc committee had been formed on February 24, 2026. However, the committee was later dissolved by the High-Level Election Supervisory Committee on March 12, 2026, resulting in further delays in processing enrolment requests.

Rajasthan Advocate Enrolment Applications Issue: Petition Filed By Law Graduate

The case began when Surendra Khinchi, a 2025 law graduate from Dr. Bhimrao Ambedkar Law University, Jaipur, approached the High Court. He had submitted his enrolment application along with all required documents and fees. He also sent representations requesting action on his application, but no decision was taken.

Similar Problems Faced By Other Candidates

The Bar Council acknowledged before the Court that several other law graduates were facing the same issue. Many applications remained pending because there was no committee available to scrutinize and approve enrolment requests.

Court Observes Candidates Cannot Wait Indefinitely

Justice Shubha Mehta observed that delays in advocate enrolment were causing serious difficulties for law graduates. The Court noted that the candidates’ right to earn a livelihood and begin their professional careers was being negatively affected because of administrative inaction.

Elections Already Completed

The Court further noted that by the time the matter was considered, the Bar Council elections had already concluded and results had been declared. Therefore, there was no justification for keeping applications pending any longer.

Importance Of Advocate Enrolment

Under the Advocates Act, law graduates must be enrolled with a State Bar Council before they can legally practice as advocates in India. Without enrolment, graduates cannot appear in courts or pursue a professional legal career.
