New Delhi: The supreme court temporarily halted an order of the Bar Council of India (BCI) that had debarred former judicial officer and advocate Narendra Kumar Jain from practicing law. The Court issued notice to the BCI and granted interim relief while examining the legality of the disciplinary action. The case has drawn attention because it involves allegations of professional misconduct and questions about due process in disciplinary proceedings against advocates.

The Bar Council of India had passed an order in July 2026 permanently debarring advocate Narendra Kumar Jain from legal practice.

According to the BCI, the action was taken over allegations of repeated, persistent, and unprovoked public attacks on the judiciary and individual judges. Jain, who previously served as a judicial officer in Madhya Pradesh before resigning and joining the legal profession, challenged the BCI order before the Supreme Court.

Supreme Court Grants Interim Relief to Advocate Narendra Kumar Jain

A Bench comprising Justice Vikram Nath and Justice Sandeep Mehta heard the matter. After considering the initial submissions, the Court decided to stay the operation of the BCI order for the time being.

The Bench directed the Bar Council of India to respond to Jain’s petition and examine the issues raised in the challenge.

The Court stated that the effect and operation of the impugned order would remain until further consideration.

What Happened During The Hearing

Senior Advocate Vivek Tankha appeared on behalf of Narendra Kumar Jain. Tankha argued that his client was debarred without being given a proper opportunity to be heard. He informed the Court that Jain had not received a copy of the BCI order. 

He also claimed that Jain had not been provided a copy of the complaint filed against him by the Bar Council. These arguments raised concerns regarding procedural fairness and the principles of natural justice.

Supreme Court Questions Advocate Narendra Kumar Jain Conduct

During the hearing, the Bench also questioned Jain regarding his conduct. The Court reportedly asked whether he was willing to correct his behavior and observed that he appeared to be a repeat offender. The judges advised him to stop making what they described as frivolous complaints against judges and members of the judiciary. The Court emphasized that responsible conduct is essential for maintaining public confidence in the justice system.

The controversy involving Narendra Kumar Jain is not new. Reports indicate that he had earlier faced criticism for comments made against members of the judiciary, including a former Chief Justice of the Madhya Pradesh High Court. Although some previous matters were resolved after explanations and apologies, subsequent remarks allegedly led to disciplinary proceedings. The State Bar Council reportedly initiated action, after which the matter reached the Bar Council of India.
