New Delhi: The Bar council of India reforms Plea filed in the Supreme Court has sought major changes in the functioning of the Bar Council of India (BCI). The petition raises concerns about the long tenure of BCI Chairman Manan Kumar Mishra and calls for fixed terms, leadership rotation, and stronger accountability measures. The plea argues that reforms are necessary to ensure fair representation and democratic functioning within India’s top legal regulatory body.

A petition has been filed before the Supreme Court seeking structural reforms in the Bar Council of India (BCI), the country’s apex body for regulating the legal profession.

The plea calls for limits on the tenure of the BCI chairman and other key office-bearers. It also seeks a transparent rotation system to ensure that representatives from different states get an opportunity to lead the institution.

According to the petition, such reforms would strengthen institutional, financial, and regulatory accountability within the BCI.

Who Filed the Bar Council of India Reforms Plea

The petition was filed by Advocate M. Varadhan through advocates Sandeep Pandey and Rajesh Singh Chauhan. The petitioner has challenged a provision under Section 4(3) of the Advocates Act, which allows a BCI member to continue in office until a successor is elected. According to the plea, this provision can result in prolonged tenures and concentration of authority.

What Changes Does the Bar Council of India Reforms Plea Seek

The petition seeks a fixed tenure of two years for the positions of chairman and vice-chairman of the BCI. It also asks the Supreme Court to direct that no individual should hold the office of chairman or vice-chairman for more than three terms during their lifetime, whether consecutive or non-consecutive.

The plea further argues that such limits should not be bypassed through alternate designations, interim arrangements, nominations, committees, or re-elections.

Concerns Over Long Tenure of BCI Chairman

The petition specifically points to the tenure of BCI Chairman Manan Kumar Mishra, who has held the position since November 2014.

According to the plea, representatives from 20 of India’s 28 states have not held the chairman’s office during the last three decades. The petitioner argues that this raises concerns about balanced representation in a national regulatory institution.

Bar Council of India Reforms Plea: Call for Rotational Leadership

The plea seeks a fair and transparent rotational mechanism for selecting the BCI chairman. According to the petition, eligible representatives from different states and regions should get periodic opportunities to lead the Bar Council of India.

The petitioner argues that leadership rotation would promote diversity, regional representation, and fresh perspectives in decision-making.

Bar Council of India Reforms Plea: Link to Recent NALSAR Controversy

The petition comes shortly after a controversy involving the BCI’s now-withdrawn decision to initiate action against students of NALSAR University of Law, Hyderabad. The issue arose after students protested against Chief Justice of India Surya Kant.

According to the petitioner, the controversy highlighted concerns regarding institutional decision-making and the concentration of regulatory authority.
