Kochi: In a significant judgment, the Kerala High Court has directed the inclusion of IPS officer D Shilpa into the Karnataka cadre, ruling that she was wrongly allocated to the Kerala cadre during the 2015 batch cadre allotment.
A Division Bench comprising Justice Amit Rawal and Justice K.V. Jayakumar passed the order, instructing the authorities to take a decision on her cadre change within two months.
Currently posted as Assistant Inspector General (AIG) at the Kerala Police Headquarters, Shilpa had approached the court after the Central Administrative Tribunal (CAT) dismissed her plea. She argued that as a native of Karnataka, her rightful allotment should have been in her home state, but due to an administrative error, she was posted in Kerala instead.
The court upheld her contention, acknowledging the mistake in the cadre allocation process and observed that the petitioner had been unfairly deprived of her home cadre rights. Advocate T. Sanjay appeared on behalf of the petitioner.
The verdict now places the onus on the central authorities and Ministry of Home Affairs to resolve the cadre reallocation within the stipulated timeline.
