Gujarat Announces GIDC Amnesty Scheme, MSMEs to Get Up to 80% Stamp Duty Relief

Gandhinagar: The Gujarat government has announced a GIDC Amnesty Scheme to ease the stamp duty burden on eligible MSME industries holding GIDC industrial plots. Under the proposed scheme, eligible entrepreneurs can receive up to 80% relief on applicable stamp duty, helping resolve long-pending cases linked to previous property transactions.

The decision, taken by Chief Minister Bhupendra Patel, follows representations from entrepreneurs and GIDC associations seeking relief from high stamp duty and penalties arising from past transactions.

Why the GIDC Amnesty Scheme Was Needed

In several earlier GIDC transactions, industrial plots and sheds changed hands through allotment letters or supplementary agreements instead of registered lease deeds. As a result, applicable stamp duty was not always paid at the time of earlier transfers.

The issue often surfaced when the current owner needed to register a lease deed, obtain a loan or complete another legal requirement. In such cases, the present plot holder could become liable for unpaid stamp duty and penalties relating to earlier transactions.

Amendments to the Gujarat Stamp Act, 1958, introduced from April 2025 also increased the financial consequences of deficient stamp duty. Depending on how the case is identified, interest and penalties can add significantly to the outstanding amount.

The new scheme aims to provide a practical resolution to this legacy burden.

MSMEs to Get Up to 80% Stamp Duty Relief

Under the proposed GIDC Amnesty Scheme, eligible cases will receive relief of up to 80% of the applicable stamp duty. The government will recover the remaining 20% along with the applicable penalty.

However, where the combined amount of 20% stamp duty and penalty is lower than the original stamp duty, the relief will be structured so that an amount equivalent to the original stamp duty is recovered.

This could substantially reduce the financial burden on current GIDC plot holders dealing with old transactions.

Who Can Benefit?

The scheme will primarily cover MSME units with a valid Udyam Registration Certificate.

Eligible transactions may include:

  • Allotment letters and related transactions
  • Share transfers
  • Lease and sub-lease transactions
  • Other eligible property transfers carried out up to June 30, 2025

The measure is particularly significant for businesses that inherited stamp duty liabilities from transactions carried out by previous plot holders.

Registration Will Remain Mandatory

The relief will come with an important condition. Current allottees seeking the benefit will have to pay the applicable stamp duty and penalty under the scheme and complete the legal registration of the concerned property.

This means the initiative is not only aimed at reducing the financial burden on entrepreneurs but also at bringing older property transactions into the formal registration system.

The government expects this to improve transparency and legal compliance in GIDC property transactions.

Relief for Appeals and Court Cases

The scheme will also provide a possible route for resolving eligible cases that are already under dispute.

Where an appeal has been filed before the competent authority and the prescribed 25% amount has been deposited, eligible applicants may be able to avail the scheme subject to its conditions.

Similarly, applicants with pending court petitions may become eligible after withdrawing the relevant petition, subject to the prescribed requirements.

Special Provision for Older Transfers

The government has proposed a specific relief mechanism for transactions made before January 1, 2018.

In such cases, 80% relief will apply to the stamp duty determined using the market value fixed for the instrument relating to the last previous transfer. The remaining 20% duty and applicable penalty will be recovered.

For transfers made on or after January 1, 2018, where stamp duty remains recoverable, the proposal provides for 80% relief on the applicable duty, with 20% duty and the applicable penalty payable.

Supporting Ease of Doing Business

The decision is part of Gujarat’s broader effort to simplify procedures and reduce obstacles faced by industries.

By resolving old stamp duty liabilities, the scheme could make it easier for MSMEs to regularise property documents, access finance and undertake future expansion.

It may also help the government recover long-pending stamp duty while bringing previously informal or incomplete property transactions into the legal registration framework.

The GIDC Amnesty Scheme therefore combines financial relief with greater legal compliance, potentially creating a more predictable environment for existing businesses and new industrial investments in Gujarat.
