New Delhi: The Biological Diversity Amendment Act 2023 IPR filings surge is becoming a major milestone in India’s innovation ecosystem. According to an official report, India has seen a sharp rise in Intellectual Property Rights (IPR) applications linked to biological resources. This growth highlights how the amended law is improving transparency, simplifying approvals, and encouraging research and industrial development while protecting biodiversity and traditional knowledge.

Details of IPR Filling After Biological Diversity Amendment Act 2023

India has recorded a strong increase in IPR filings related to biological resources.

  • 857 applications were received between April 2024–March 2025

This clearly shows a significant upward trend in innovation linked to biodiversity.

At the same time, the National Biodiversity Authority (NBA) issued:

  • 792 Certificates of Registration (CoRs) in 2024–25
  • 885 CoRs in 2025–26

This reflects faster processing and improved efficiency in approvals.

What Changed Under the Biological Diversity Amendment Act 2023

The Biological Diversity (Amendment) Act, 2023 has introduced key reforms:

1. Mandatory Registration Before IPR

Applicants must now obtain a Certificate of Registration (CoR) from the NBA before applying for patents or other IPR based on Indian biological resources.

2. Better Transparency and Compliance

The law ensures:

  • Clear rules for access to biological resources
  • Strong monitoring of usage
  • Fair sharing of benefits with stakeholders

3. Simplified Approval Process

A streamlined, registration-based system has reduced delays and made approvals easier for businesses and researchers.

Boost Across Multiple Industries

The rise in IPR filings is not limited to one sector. It spans across:

  • Biotechnology
  • Pharmaceuticals
  • Chemicals
  • Food science
  • Agrochemicals
  • Biomedical engineering
  • Textile and polymer industries

This shows that biodiversity-based innovation is growing across knowledge-driven sectors in India.

Impact on Research and Business

The reforms are helping India build a balanced innovation ecosystem:

  • Easier research and business approvals
  • Strong legal protection for biological resources
  • Better alignment with conservation goals
  • Fair benefit-sharing with local communities

The law ensures that economic growth does not harm biodiversity.

Why This Matters for India

This surge in IPR filings shows that India is:

  • Becoming a global hub for bio-based innovation
  • Encouraging sustainable industrial development
  • Protecting traditional knowledge and natural resources

The amendment supports both economic growth and environmental protection together.
