The Supreme Court dismissed the West Bengal government’s petition challenging a Delhi High Court order refusing to interfere with a Central Administrative Tribunal (CAT) verdict asking the state to grant a No Objection Certificate (NOC) in a case involving the cadre transfer of an IPS officer from West Bengal to Rajasthan.
Sagar, a 2019-batch IPS officer from the West Bengal cadre, had applied to the tribunal for a change of cadre from West Bengal to Rajasthan on the grounds that his wife is also an IPS officer from the Rajasthan cadre and that similarly placed couples were given a change of cadre.
The tribunal’s Principal Bench in New Delhi partially granted the original case submitted by the IPS officer. While SC dismissed the West Bengal government’s plea against the HC order on IPS officer transfer and asked the state to award him a NOC within four weeks, failing which the NOC would be considered to have been issued.
