Explained: Why the Supreme Court Imposed ₹25,000 Cost on the Union of India

New Delhi; In a significant judicial rebuke, the Supreme Court of India has imposed a ₹25,000 cost on the Union of India after the central government provided incorrect information during a hearing. 

The top court said that the error had the potential to influence judicial decision-making and could have led to a wrong order in a sensitive criminal investigation case. 

The cost, directed to be paid to the Armed Forces Battle Casualties Welfare Fund, underscores the judiciary’s insistence on accuracy and transparency from government authorities in court proceedings.

Background of the Union of India Incorrect Information Case

The Supreme Court case — Sathyan Naravoor v. Dr. Jacob Thomas IPS & Ors. — dealt with a criminal investigation involving former Kerala DGP Jacob Thomas.

During a hearing on the case, the Additional Solicitor General S.V. Raju, representing the Union of India, informed the court that the State had not provided a list of officers travelling to the Netherlands in connection with the investigation.

However, the petitioner’s counsel showed that the information was already submitted by the Kerala Vigilance Department through an official letter. 

The discrepancy forced the court to pause proceedings and ask the government to verify facts.

Union of India Incorrect Information Case: Bench’s Observations 

When the case resumed, the ASG conceded that the earlier information was incorrect. The court noted this could have misled the Bench and potentially resulted in a wrongful judicial order. This is a serious concern, especially in criminal matters where factual accuracy is critical to justice.

Union of India Incorrect Information Case: Court’s Decision and Direction

Taking note of the inaccurate submission, the Supreme Court ordered the Union of India to pay ₹25,000 as cost. The Bench directed that the amount must be deposited in the Armed Forces Battle Casualties Welfare Fund within a specified period.

Purpose of the Cost

Such costs are not penalties in a punitive sense but serve as a formal judicial admonition. They are intended to reinforce responsibility on parties — particularly government bodies — to ensure accuracy in court filings and statements.

Importance of Accurate Court Statements

Courts rely on truthful, complete, and accurate information when deciding legal questions. An incorrect statement — even if made without bad intentions — can lead to a significant miscarriage of justice.

In sensitive criminal matters, these errors risk affecting the rights and freedoms of individuals involved or even broader legal outcomes.
