Big Relief for Survivors: Supreme Court Broadens Acid Attack Victim Definition to Include Internal Damage and Ingestion Cases

New Delhi: The Supreme Court expands acid attack victim definition under the Rights of Persons with Disabilities Act, 2016, in a landmark move that strengthens protection for survivors. In a significant judgment, the Court clarified that victims suffering internal injuries due to acid exposure or ingestion will now also be recognised as acid attack victims. 

This decision ensures broader legal recognition, access to rehabilitation, and protection for many overlooked survivors. The ruling highlights the need for a more inclusive interpretation of disability laws in India.

The Supreme Court of India held that the existing definition of acid attack victims under the RPwD Act was too narrow and restrictive.

A bench comprising Chief Justice of India Surya Kant and Justice Joymalya Bagchi ruled that:

  • Acid attack victims are not limited to those with visible external injuries
  • Victims suffering internal damage due to acid exposure must also be included
  • Cases involving forced ingestion of acid are equally serious and must be recognised

This interpretation expands the legal meaning of acid attack survivors under disability law.

1. Recognition of Invisible Injuries

Earlier, legal recognition focused mostly on visible disfigurement. Now, victims with internal organ damage, which can be life-threatening, are also covered.

2. Access to Rights and Benefits

Under the RPwD Act, recognised victims are entitled to:

  • Reservation benefits
  • Financial assistance and compensation
  • Legal protection and support

This ruling ensures that more victims can access these benefits.

3. Closing Legal Gaps

The Court acknowledged that many victims were excluded unfairly because their injuries were not externally visible.
