Big Relief for Graduates: Supreme Court Rules Degrees Earned Before University Was Declared Defunct Cannot Be Invalidated

New Delhi: In a landmark judgment, the Supreme Court of India has clarified that degrees obtained before a university was declared defunct remain valid, giving relief to employees whose services were terminated on the ground that their university was later struck down.

The court held that if a law or recognition was valid at the time a degree was earned, it cannot be invalidated by later legal developments. This ruling protects the academic rights of students and employees across the country.

This case arose when several librarians in Bihar lost their jobs because the university from which they earned their degrees was later declared defunct. The government terminated their services on the technical ground that the degree-granting institution no longer existed under law.

The case stemmed from the Chhattisgarh Niji Kshetra Vishwavidyalaya Act, 2002, under which private universities including the University of Technology and Science, Raipur were established. The librarians had completed their Bachelor of Library Science (B.Lib.) degrees in 2004 — when the university was officially functioning and its courses were recognised.

A two-judge bench of Justices Rajesh Bindal and Vijay Bishnoi reversed the earlier judgment of the Patna High Court. The High Court had upheld the government’s decision to terminate the librarians on the basis that the university was later declared unconstitutional.

The Supreme Court held:

  • Degrees earned while the governing law was in force and recognised are protected under law.
  • Subsequent invalidation of the university’s statute cannot retroactively destroy the legal validity of degrees already awarded.
  • Termination of employment solely because the degree-granting university was declared defunct was held to be unjust.

In effect, the Supreme Court ruled that degrees obtained before the university lost legal status remain valid and enforceable in law.
