New Delhi: The Delhi High Court directed GST authorities across India to ensure that no new GST registration is granted without biometric-based Aadhaar authentication.

The order aims to curb the growing problem of fraudulent GST registrations that are allegedly being obtained using stolen, forged, or misused PAN and Aadhaar details. The Court said strict implementation of biometric verification is necessary to protect the tax system and prevent revenue losses.

A Division Bench of Justice Anil Khetrapal and Justice Shail Jain passed the order while hearing a case related to fraudulent GST registrations.

The Court directed authorities across the country not to approve any fresh GST registration unless the applicant completes biometric Aadhaar authentication. The judges noted that the government had already announced biometric verification as mandatory, but implementation remained incomplete in many areas.

Court Expresses Concern Over Delay

The Bench observed that more than a year had passed since the government informed Parliament that biometric Aadhaar authentication would be compulsory for GST registration. However, the Court noted that the policy had not been fully implemented nationwide. The judges stated that authorities were unable to explain any practical difficulties in enforcing the requirement.

The Court referred to figures shared by the Union Ministry of Finance in Parliament. According to government data, around 2,800 fraudulent GST registrations using stolen or frozen PAN and Aadhaar details were detected during 2023-24. 

These cases were linked to tax evasion worth approximately ₹15,085 crore. In 2024-25, authorities identified another 1,654 suspicious GST registrations involving tax evasion of nearly ₹13,109 crore. These numbers highlighted the urgent need for stronger identity verification mechanisms before granting GST registrations.

How Fraudsters Exploit Identity Documents

Fraudsters often misuse PAN and Aadhaar details belonging to unsuspecting individuals. Using these identities, they create fake companies, obtain GST registrations, generate bogus invoices, and claim wrongful tax benefits. 

Such activities not only cause huge revenue losses but also create legal problems for innocent citizens whose identities are misused.

Why Biometric Aadhaar Verification For GST Registration Matters

Biometric verification uses fingerprints, iris scans, or facial authentication linked directly to Aadhaar records. This process makes it significantly harder for fraudsters to obtain GST registrations using stolen documents because physical presence and identity confirmation become necessary.

Tax experts believe nationwide biometric verification can improve transparency, strengthen compliance, and reduce fake registrations.

Government’s Ongoing Efforts

The GST Network (GSTN) and tax authorities have already introduced Aadhaar-based authentication for many applicants. The latest court order is expected to accelerate nationwide implementation and ensure uniform compliance across all states and union territories.

Court Allows Authorities To Highlight Practical Challenges

While directing immediate implementation, the Court also gave authorities the opportunity to inform it about any genuine operational difficulties. The judges indicated that practical concerns, if any, could be examined during future hearings without delaying the broader objective of preventing GST fraud.

Additional Safeguards Suggested

The Court also asked authorities to examine measures suggested by Senior Advocate Tarun Gulati. These recommendations focus on preventing misuse of PAN and Aadhaar details and strengthening the overall GST registration process against fraudulent activities.

Next Hearing Scheduled

The matter is scheduled to be heard again on September 22, 2026. The upcoming hearing may review implementation progress and any challenges faced by authorities in enforcing biometric Aadhaar verification across the country.

Genuine businesses seeking GST registration may now have to complete biometric Aadhaar authentication before obtaining approval. While this could add an additional verification step, experts believe it will improve trust in the GST system and help eliminate fake entities from the tax network.
