Jaipur: Rajasthan AAG appointment controversy reached the Supreme Court, where the court dismissed a plea challenging the appointment of advocate Padmesh Mishra as Additional Advocate General (AAG) for Rajasthan. Padmesh Mishra is the son of sitting Supreme Court judge Justice Prashant Kumar Mishra. The apex court upheld the earlier Rajasthan High Court decision that had validated the appointment, bringing an end to the legal challenge.

Supreme Court Rejects Challenge To Rajasthan AAG Appointment

The Supreme Court on August 31 dismissed a petition challenging the appointment of Padmesh Mishra as Rajasthan’s Additional Advocate General.

The case was heard by a Bench comprising Justices Aravind Kumar and Vipul M. Pancholi. The Bench refused to interfere with the Rajasthan High Court judgment that had earlier upheld the appointment.

Who Is Padmesh Mishra

Padmesh Mishra is the son of Justice Prashant Kumar Mishra, who currently serves as a judge of the Supreme Court of India. His appointment as Additional Advocate General for Rajasthan became the subject of legal scrutiny after a petition questioned the decision of the state government.

Why Was The Rajasthan AAG Appointment Challenged

According to reports, the petitioner argued that the Rajasthan government had amended its litigation policy and appointed Padmesh Mishra despite him allegedly not meeting the usual requirement of ten years of legal practice.

The challenge claimed that the appointment was inconsistent with the state’s policy framework governing appointments of law officers.

Rajasthan High Court Had Earlier Upheld Rajasthan AAG Appointment

Before reaching the Supreme Court, the matter was heard by the Rajasthan High Court. A Single Judge dismissed the petition on February 4, 2025. The High Court held that the State Government had the authority under Clause 14.8 of its litigation policy to appoint a person to such a post after considering relevant experience and suitability.

Court Found No Arbitrariness

The Rajasthan High Court also rejected the challenge to Clause 14.8 itself. The court found no evidence showing that the provision was arbitrary or that the government had exercised its powers improperly while making the appointment.

Supreme Court Affirms High Court View

The Supreme Court’s decision effectively confirms the Rajasthan High Court’s interpretation of the state’s litigation policy. By dismissing the plea, the apex court allowed Padmesh Mishra’s appointment as Additional Advocate General to continue without any legal obstacle.
