Supreme Court Gives Huge Relief To Judicial Aspirants, Cuts Practice Requirement By Two-Thirds

New Delhi: The judicial service practice requirement has been significantly revised by the Supreme Court of India. In a major decision, the Court reduced the mandatory legal practice requirement for entry-level judicial service examinations from three years to one year. 

The Court also introduced a structured system of one year of judicial training and one year of law clerkship for selected candidates. The decision aims to balance practical legal experience with easier access to judicial careers for young law graduates.

A Constitution Bench of the Supreme Court considered petitions challenging its May 2025 judgment that had made three years of legal practice mandatory for candidates seeking appointment as Civil Judges (Junior Division).

While refusing to completely remove the experience requirement, the Court decided to reduce it from three years to one year.

The judgment seeks to ensure that candidates have practical courtroom exposure while avoiding unnecessary barriers for fresh law graduates.

One Year Practice Requirement

For judicial service examinations notified on or after April 1, 2027, candidates must have at least one year of active legal practice before appearing for the examination. The practice period will be verified through a formal certificate and records showing participation in actual judicial proceedings.

New Two-Year Professional Development Model

The Court introduced a structured post-selection training system. Selected candidates will not immediately receive regular appointments. Instead, they will undergo:

  • One year of intensive training at the State Judicial Academy.
  • One year of law clerkship under judicial supervision.

This framework is intended to provide practical courtroom exposure and judicial skills before candidates assume full judicial responsibilities.

How The Clerkship System Will Work

Training At Judicial Academies

Candidates selected through judicial service examinations will first undergo one year of intensive institutional training. During this period, they will receive training in judicial procedures, court administration, legal reasoning, and case management.

Law Clerkship Under Judges

After academy training, candidates will complete one year of clerkship. The clerkship will be conducted under the supervision of judicial officers and High Court judges. Performance reports will be prepared to assess the trainee’s suitability for regular appointment.

The Court also provided transitional arrangements for ongoing recruitment cycles. High Courts have been asked to ensure that eligible candidates are not unfairly disadvantaged during the transition to the new system. The revised framework will fully apply to future recruitment notifications issued after April 2027.

Arguments Raised Before The Court

Several senior advocates argued that the earlier three-year requirement could discourage talented law graduates from joining the judiciary. Concerns were also raised that women candidates, persons with disabilities, and young graduates could be disproportionately affected by a lengthy waiting period before becoming eligible for judicial service examinations. Some counsels suggested that structured training and clerkships could be a better alternative to a long mandatory practice period.
