New Delhi: The Supreme Court has directed the Insurance Regulatory and Development Authority of India (IRDAI) to provide detailed data on insurance policies issued by public and private insurers to these groups. The direction came while hearing a Public Interest Litigation (PIL) that raises concerns about the rights and welfare of neurodivergent persons and persons with disabilities.

The Court asked the regulator to gather data from both public sector and private sector insurance companies before the next hearing.
This information will help the Court understand the current level of insurance coverage available to persons with disabilities and identify any gaps in access to insurance services.
Why The Court Sought This Information
The PIL claims that insurance coverage for many persons with disabilities remains limited or inadequate despite existing regulations. The petitioner argued that many families face difficulties obtaining life and health insurance for people with neurodevelopmental conditions.
The Court is examining whether current policies and their implementation are effectively protecting the rights of persons with disabilities.
PIL Highlights Challenges Faced By Neurodivergent Persons
The petition raises concerns about what it describes as persistent shortcomings in supporting people with neurodivergent conditions such as autism, dyslexia, ADHD, intellectual disabilities, and other developmental disorders.
According to the plea, there are gaps in healthcare access, rehabilitation services, public awareness, and social inclusion. The petitioner also alleges that many support systems required under existing laws are not fully available on the ground.
Laws Mentioned In The Petition
The PIL refers to several important laws designed to protect the rights of persons with disabilities, including:
- National Trust Act, 1999
- Rights Of Persons With Disabilities Act, 2016
- Mental Healthcare Act, 2017
- National Trust (Amendment) Act, 2018
These laws provide legal protections, rights, and support mechanisms for persons with disabilities in India.
PwD Insurance Policies: Concerns Beyond Insurance Coverage
The petition does not focus only on insurance. It also raises concerns about accessibility in air travel, railways, metro systems, public infrastructure, and healthcare services.
The plea highlights the need for sensory-friendly facilities, trained personnel, better diagnosis systems, and easier access to disability certification processes. The petitioner has also pointed to challenges in inclusive education and employment opportunities for persons with disabilities.
Employment And Education Issues
According to the petition, some neurodivergent individuals face difficulties finding long-term employment opportunities. The plea also highlights concerns regarding reasonable accommodation in educational institutions and workplaces.
The petitioner argues that stronger implementation of disability rights protections is needed to ensure equal opportunities.
Demand For The Comprehensive National PwD Insurance Policies
The petitioner has requested a broader national framework covering:
- Early identification and diagnosis
- Mental healthcare support
- Rehabilitation services
- Residential support systems
- Insurance coverage
- Inclusive education
- Employment opportunities
The plea also seeks improved awareness programs and training for professionals working in healthcare, education, aviation, law enforcement, and public services.
Focus On Better Accessibility
The petition recommends expanding disability certification centers and simplifying the Unique Disability ID (UDID) process. It also calls for more community-based mental health services and improved accessibility at airports, railway stations, and other transport hubs. Such measures, according to the plea, would help create a more inclusive environment for persons with disabilities.
