In a significant development, the Supreme Court of India granted bail to Jharkhand cadre IAS officer Vinay Kumar Choubey, overturning an earlier order of the Jharkhand High Court that had denied him relief. The ruling comes as a major turning point in an ongoing corruption case being investigated by the Anti-Corruption Bureau.
Choubey, a 1999-batch IAS officer currently under suspension, has been facing multiple serious allegations, including corruption, land irregularities, and disproportionate assets.
Supreme Court Overturns High Court Decision
A bench comprising Justices B.V. Nagarathna and Ujjal Bhuyan heard the criminal appeal challenging the High Court’s January 6, 2026 order, which had rejected Choubey’s bail plea in connection with FIR No. 09/2025.
The FIR was registered by the Anti-Corruption Bureau in Hazaribagh and includes charges such as criminal breach of trust, cheating, forgery, criminal conspiracy, and violations under the Prevention of Corruption Act.
After considering the arguments presented by both sides, the apex court set aside the High Court’s decision and directed that Choubey be released on bail, subject to strict conditions.

During the hearing, both the defense and prosecution presented sharply contrasting arguments regarding Choubey’s role and entitlement to bail.
The defense argued that the alleged offenses date back to 2009, yet Choubey was arrested only on August 13, 2025, and has remained in judicial custody since then. His counsel also emphasized that two co-accused in the case had already been granted bail, invoking the legal principle of parity.
On the other hand, the state government opposed the bail plea, contending that Choubey played a central role in alleged land transfer irregularities during his tenure as Deputy Commissioner of Hazaribag. The prosecution also argued that his senior position and alleged involvement in other cases set him apart from co-accused individuals.
Court’s Observations and Bail Conditions
The Supreme Court, while granting relief, took note of the duration of Choubey’s custody and the bail granted to co-accused persons in the same case.
The bench directed that Choubey be released on bail with stringent conditions, including full cooperation with the trial process, non-interference with witnesses, and strict prohibition on tampering with evidence. The court also made it clear that any violation of these conditions would lead to immediate cancellation of bail.
This decision is expected to have a bearing on the ongoing trial as the case progresses.
Who is Vinay Kumar Choubey?
Vinay Kumar Choubey is a senior Indian Administrative Service officer from the 1999 batch of the Jharkhand cadre. Born on October 27, 1975, he hails from Bokaro Steel City in Jharkhand.
An engineering graduate in Computer Science from BITS Pilani, Choubey has held several key administrative positions in the Jharkhand government. He is fluent in both English and Hindi and has served in influential policymaking roles during his career.
Career Highlights and Key Positions
Over the years, Choubey has occupied several prominent roles in the state administration, including serving as Principal Secretary to the Chief Minister under Hemant Soren. He has also held important portfolios such as Secretary of the Excise Department and Principal Secretary of the Panchayati Raj Department.
In addition, he served as Managing Director of the Jharkhand State Beverage Corporation Limited and as Deputy Commissioner of Hazaribagh, a tenure that is now under scrutiny in connection with ongoing investigations.
Multiple Legal Challenges and Investigations
As of 2026, Choubey is facing multiple legal challenges across different cases being probed by the Anti-Corruption Bureau.
In May 2025, he was arrested in connection with an alleged liquor policy scam linked to irregularities in the 2022 excise policy, which reportedly caused a loss of ₹38 crore to the state exchequer. He has recently secured bail from the Supreme Court in this matter.
However, he continues to remain entangled in a separate land scam case involving the alleged illegal transfer of notified forest land and Khasmahal land in Hazaribagh during his tenure as Deputy Commissioner. His bail plea in this case had earlier been rejected by the High Court in January 2026.
Additionally, the ACB has registered a disproportionate assets case against him, alleging that he amassed wealth exceeding 50 percent of his known sources of income. Investigations in this matter also extend to his wife and close relatives.

Vinay Kumar Choubey is currently under suspension from service as investigations continue in multiple cases. While the Supreme Court’s decision to grant bail offers temporary relief, legal proceedings against him remain ongoing, and the outcome of the trials will be closely watched.
