Raipur: The Supreme Court has allowed the Chhattisgarh government to approach the High Court for cancellation of former IAS officer of 1990 batch from the Chattisgarh cadre, Anil Tuteja’s bail if he misuses the relief or violates its conditions. The decision, delivered on October 29, 2026, came while hearing the state government’s challenge to bail granted to Tuteja in corruption-related cases.

The Supreme Court also clarified that observations made by the High Court while granting bail must not influence the trial court during the ongoing criminal proceedings.

Supreme Court Directions On Anil Tuteja Bail

A bench comprising Chief Justice of India Surya Kant and Justices Joymalya Bagchi and V. Mohana heard the Chhattisgarh government’s appeal against the bail granted to retired IAS officer Anil Tuteja.

The state government had challenged the bail orders passed in December 2025 and January 2026 in fresh corruption cases. However, the Supreme Court refused to interfere with the bail orders and disposed of the state’s appeal.

The court clarified that the Chhattisgarh government could approach the High Court if it found any evidence that Tuteja had misused the freedom granted to him through bail.

Supreme Court Says Anil Tuneja Bail Observations Must Not Affect Trial

The Supreme Court made an important clarification regarding the observations made by the High Court while granting bail.

The bench stated that these observations were limited to the consideration of bail applications. They should not affect the trial court’s decision when examining the evidence.

The court also observed that suspicion of corruption must be supported by strong and reliable evidence before a person can be held guilty. This means that the trial court must independently examine the evidence and decide the cases according to law.

Corruption Cases Against Anil Tuteja

Retired IAS officer Anil Tuteja has faced investigations in several alleged corruption cases in Chhattisgarh. These cases include:

1. Alleged Liquor Scam

The alleged liquor scam is one of the major cases under investigation in Chhattisgarh.

The Economic Offences Wing (EOW) and Anti-Corruption Bureau (ACB) have been investigating alleged financial irregularities connected with the state’s liquor business.

The investigating agencies recently filed their 10th supplementary charge sheet in this case. It reportedly named 20 individuals, including former state Congress treasurer Ramgopal Agrawal, and 22 firms as accused.

2. District Mineral Foundation (DMF) Case

Tuteja has also faced investigation into alleged irregularities involving the District Mineral Foundation (DMF).

The case concerns alleged misuse and irregular allocation of funds meant for the development of areas affected by mining activities.

The Supreme Court had earlier granted him bail on May 18 in a corruption case involving alleged DMF irregularities.

3. Coal Levy Scam

The former IAS officer has also been investigated in the alleged coal levy scam.

The case concerns allegations of illegal collections linked to coal transportation and related business activities in Chhattisgarh. The allegations in these cases remain subject to judicial proceedings. Guilt can only be established through the legal process.

When Can Anil Tuteja Bail Be Cancelled

The Supreme Court has clarified that the Chhattisgarh government can approach the High Court if there is evidence of misuse of bail.

If the government establishes that bail conditions have been violated or the concession has been misused, it can seek appropriate legal action. However, bail will not be cancelled automatically. The High Court will examine the circumstances and decide the matter according to law.

The Supreme Court’s decision therefore preserves the state’s legal option while allowing the ongoing trials to proceed independently.
