Rajasthan HC Wants Faster Criminal Investigations, Seeks Reply On Police Wing Separation

The Rajasthan High Court has asked the State Finance Department to respond to a proposal for separating police investigation and law & order wings. The reform aims to speed up criminal investigations and improve policing across Rajasthan.

Jaipur: The Rajasthan High Court police investigation and law & order separation issue has moved forward after the court asked the State Finance Department to explain the status of a proposal aimed at separating the two police functions. The move is part of ongoing police reforms designed to ensure faster criminal investigations, better policing, and timely justice for citizens.

Rajasthan Police Wing Separation Case: Why Did The High Court Intervene

The Rajasthan High Court, led by Justice Anoop Kumar Dhand, is monitoring the implementation of police reforms in the state. During the hearing, the court directed that the Principal Secretary of the Finance Department be added as a party in the case. The department has been asked to submit a report explaining what action has been taken on the proposal sent by the Police Headquarters and the Home Department.

Rajasthan Police Wing Separation Case: What Is The Proposal

The proposal aims to separate police work into three specialised wings:

  • Law & Order Wing
  • Investigation Wing
  • Administration Wing

According to the Rajasthan Government, a pilot project has already been approved for 20 police stations across 16 districts. However, the proposal requires the creation of 828 new posts, which needs approval from the Finance Department.

Why Is Rajasthan Police Wing Separation Important

The High Court observed that investigating officers often perform both investigation and law & order duties. Because of this, criminal investigations can be delayed when officers are deployed for:

  • VIP security
  • Festivals
  • Public events
  • Emergency law & order situations

The court believes that separating these responsibilities will help police officers focus on investigations, improve expertise, and complete cases more quickly.

Court Refers To Earlier Directions

This case follows earlier orders issued by the Rajasthan High Court after it found that some criminal investigations had remained pending for years because the same officers handled both investigation and law & order work. The court also referred to the Supreme Court’s judgment in Prakash Singh v. Union of India, which supported police reforms, including separating investigation duties from routine law & order responsibilities. It also noted the Law Commission’s recommendations supporting this reform.

Rajasthan Police Wing Separation Case: Concern Over Forensic Infrastructure

The High Court also highlighted the shortage of modern forensic facilities in Rajasthan. According to the court, police often depend on forensic laboratories outside the state, leading to unnecessary delays in criminal investigations.

The court stated that the government has a constitutional responsibility to provide proper infrastructure to ensure fair and speedy investigations.

What Happens Next?

The Rajasthan High Court has asked the Finance Department to submit its report on the proposal.

The matter has been listed for the next hearing on August 24, 2026, when the court will review the progress made by the State Government.
