New Delhi/Jammu: In a significant move aimed at strengthening accountability and ensuring compliance with service rules, the Ministry of Home Affairs (MHA) has directed all segments of the AGMUT cadre not to sanction or release pensionary benefits to retiring IAS and IPS officers without obtaining prior vigilance clearance from the ministry.
The directive, issued through a communication dated May 7, 2026, has been sent to Chief Secretaries and Administrators across all AGMUT cadre segments, including Jammu & Kashmir, Delhi, Arunachal Pradesh, Mizoram, Goa, Puducherry, Chandigarh, Ladakh, Andaman & Nicobar Islands, Dadra & Nagar Haveli and Daman & Diu, and Lakshadweep.
MHA Cites Instances of Pension Release Without Complete Verification
According to the Ministry, the decision was taken after it noticed several instances where pensionary benefits of All India Services (AIS) officers were sanctioned and released without comprehensive verification of their vigilance status.
The issue was particularly observed in cases involving officers who had served across multiple AGMUT cadre segments during their careers.
The MHA noted that in some cases, the authority responsible for disbursing retirement benefits relied solely on local vigilance inputs without verifying the officer’s complete vigilance record from the cadre-controlling authority, namely the Ministry of Home Affairs.
Concern Over Pending Disciplinary and Criminal Cases
The ministry observed that certain cadre segments later claimed they were unaware of disciplinary proceedings or criminal cases that had been initiated before an officer joined their jurisdiction.
As a result, retirement benefits were released despite the existence of vigilance-related concerns that were known to other cadre segments or the cadre-controlling authority.
To prevent recurrence of such situations, the MHA has now made prior vigilance clearance mandatory in every case involving IAS and IPS officers of the AGMUT cadre.
Strict Compliance with AIS (DCRB) Rules, 1958
The communication specifically directs all cadre segments to ensure strict adherence to the provisions of the All India Services (Death-cum-Retirement Benefits) Rules, 1958 [AIS (DCRB) Rules, 1958].
Under the new instructions, authorities must undertake pre-retirement verification of vigilance status from the MHA before processing pensionary benefits.
The ministry has categorically stated that no pensionary benefits should be sanctioned or released until vigilance clearance is formally obtained from the cadre-controlling authority.
All AGMUT Segments Covered
The directive applies to all administrative units forming part of the AGMUT cadre, including:
- Jammu & Kashmir
- National Capital Territory of Delhi
- Arunachal Pradesh
- Mizoram
- Goa
- Puducherry
- Chandigarh
- Andaman & Nicobar Islands
- Ladakh
- Dadra & Nagar Haveli and Daman & Diu
- Lakshadweep
The communication has also been sent to the Commissioner of Police, Delhi Police Headquarters.
Aim is Greater Accountability and Uniformity
Officials indicated that the directive seeks to establish a uniform mechanism for processing retirement benefits of IAS and IPS officers serving under the AGMUT cadre, where officers frequently serve in multiple Union Territories and states during their careers.
By mandating verification from the MHA, the government aims to ensure that pending vigilance issues, disciplinary proceedings, or criminal investigations are not overlooked during retirement processing.
The ministry emphasized that the instructions have been issued with the approval of the competent authority and are intended to strengthen compliance with existing service rules governing retirement benefits of All India Services officers.
What the New Order Means
Under the revised procedure:
- Vigilance status verification from MHA will be compulsory before retirement benefits are processed.
- Pensionary benefits cannot be released solely on the basis of local vigilance reports.
- All AGMUT cadre segments must seek clearance from the cadre-controlling authority.
- The measure applies to both IAS and IPS officers serving in the AGMUT cadre.
- The objective is to prevent release of retirement benefits in cases involving pending disciplinary or criminal proceedings.
The move is expected to bring greater scrutiny and uniformity to pension processing for senior civil and police officers serving under the AGMUT cadre structure.
