Amaravati: The Andhra Pradesh High Court has strongly criticised the state government over what it termed as arbitrary functioning of IAS officers in matters related to employee promotions and administrative accountability.
The sharp observations came from Justice Battu Devanand, who expressed displeasure over the government’s failure to act despite repeated allegations of misconduct involving senior bureaucrats.
Court Questions Government Inaction
During the hearing, the court took serious note of the lack of response from the state government and criticised it for treating such issues lightly.
Justice Battu Devanand observed that repeated complaints regarding the conduct of IAS officers were not being addressed adequately, raising concerns over administrative accountability.
Focus on IAS Officer Babu Ahmed
The court specifically pulled up the administration for not initiating action against Babu Ahmed, who is currently serving as Chief Commissioner of State Taxes.
Ahmed has been accused of withholding promotion files even after Departmental Promotion Committee (DPC) meetings were conducted, leading to delays in employee promotions.
Petition by Employees’ Association
The matter came up during the hearing of a petition filed by M Ramesh, who highlighted the adverse impact of delays in promotions on employees’ careers and financial prospects.
The court acknowledged that such delays are serious and can harm the professional growth of employees.
Strong Warning from the Court
Taking a stern view, the High Court stated that it could not remain indifferent to such issues and warned of strict action if the allegations are proven.
The Bench observed that it may even direct the Central Government to initiate removal proceedings against the officer if misconduct is established. It further remarked that, had it possessed the authority, it would have ordered immediate suspension.
Right to Fair Promotion Emphasised
The court underlined that every government employee—from junior staff to senior Officials—has a legitimate right to be considered for promotion based on merit, and such opportunities cannot be denied arbitrarily.
During the proceedings, counsel for Babu Ahmed informed the court that a counter affidavit would be filed and a fresh DPC would be conducted, citing the end of the panel year.
