New Delhi: In a significant development, the Central Administrative Tribunal has pulled up the Madhya Pradesh government over delays in the IPS induction process, raising serious concerns about administrative lapses.
The observations came during the hearing of a petition filed by three 1998-batch State Police Service officers who were excluded from consideration for induction into the Indian Police Service (IPS).
Officers Miss IPS Induction Due to Delay
The petitioners argued that they lost the opportunity to be inducted into the IPS after crossing the upper age limit of 56 years. They attributed this to a prolonged delay in conducting the mandatory cadre review.
According to rules, cadre reviews are to be conducted every five years. However, the review due in 2018 was conducted only in 2022—after a delay of four years.
By the time the process was completed, the officers had crossed the age threshold, rendering them ineligible despite meeting all other criteria. Notably, the officers have completed between 26 to 27 years of service.
Tribunal Questions Centre and State
The Central Administrative Tribunal questioned the functioning of both the state and central governments in the matter and issued notices to them seeking responses.
The tribunal also granted interim relief to the petitioners and directed that status quo be maintained until further orders.
Prima Facie Case Established
Observing that a prima facie case existed in favour of the applicants, the tribunal acknowledged the argument that administrative delays should not deprive eligible officers of career progression.
The petitioners have contended that the delay reflects a failure of governance and sought relief on the grounds that they should not suffer for lapses beyond their control.
Potential Wider Impact
Legal experts believe the case could set an important precedent in addressing delays in cadre reviews and induction processes across services. It may also strengthen accountability mechanisms for both state and central authorities.
