The Karnataka High Court has effectively cleared the way for the promotion of 2000-batch Karnataka cadre IPS officer Ms. D Roopa Moudgil by directing her to submit a fresh application for the position of Additional Director General of Police (ADGP). The court also instructed the state government to review her application within two months, ensuring compliance with relevant laws.
Ms. Roopa Moudgil is currently facing a criminal defamation case filed against her by IAS officer Ms. Rohini Sindhuri (2009 batch). Sindhuri had sought to block Roopa’s promotion, citing the ongoing investigation in the defamation case. However, the court emphasized that the promotion process is confidential under Department of Personnel and Training (DoPT) regulations.
In its ruling, a single-member bench led by Justice M. Nagaprasanna dismissed the claim that the defamation case should impact Roopa’s promotion. The bench categorized the defamation case as a personal matter and ruled that it should not influence the promotion process. It also directed Roopa to submit a new application to the DoPT for evaluation, ensuring that her promotion is assessed without external influence.
Both the Advocate General and the Law Department of the state government clarified that the disputes between the two women bureaucrats were personal in nature and did not affect their professional roles or terms of service.
Ultimately, the bench ruled that the promotion process was solely the prerogative of the DoPT and Ms. Roopa Moudgil, and Ms. Rohini Sindhuri had no right to interfere in it. Consequently, the court dismissed Ms. Sindhuri’s petition.
