New Delhi: The National Company Law Tribunal (NCLT) has temporarily suspended the functioning of Court VI at its Mumbai Bench from October 13, 2026, due to vacancies in tribunal member positions. The NCLT Mumbai Bench Court VI suspension will remain in place until further orders. The tribunal has directed that all pending cases before Court VI be transferred to the five other courts at the Mumbai Bench to ensure that proceedings can continue.

The NCLT issued an administrative order dated October 9, 2026, announcing the temporary suspension of Court VI. The decision was taken because of vacancies in the posts of members at the Mumbai Bench.

According to the order, Court VI will stop functioning from October 13, 2026. The suspension will continue until the tribunal issues further instructions. The decision was approved by the NCLT President under Rule 16(d) of the National Company Law Tribunal Rules, 2016.

What Will Happen To Pending Cases

The NCLT has directed that all pending matters before Court VI be transferred to the five remaining courts of the Mumbai Bench.

These courts are Courts I, II, III, IV and V. The cases will be distributed among them according to the administrative order and its annexure. The tribunal has also instructed the concerned court officers to transfer and receive the relevant case records. They must list the matters for their next scheduled hearing dates in accordance with the last orders passed in those cases.

How Will The Case Redistribution Work

The redistribution covers matters filed under Sections 7, 9, 10 and 95 of the Insolvency and Bankruptcy Code (IBC), 2016.

Section 7 Cases

Section 7 of the IBC deals with insolvency proceedings initiated by financial creditors against companies that have defaulted on their financial obligations. According to the order, these cases have been divided into five groups based on their serial numbers, as specified in the annexure.

Section 9 Cases

Section 9 of the IBC deals with insolvency proceedings initiated by operational creditors, such as suppliers, when a company fails to pay its dues and the legal requirements for filing are met. These matters have also been distributed among the remaining five courts according to the tribunal’s directions.

Sections 10 And 95 Cases

Section 10 concerns insolvency applications filed by corporate applicants themselves, subject to the conditions prescribed by law.

Section 95 deals with applications to initiate personal insolvency resolution or bankruptcy proceedings against personal guarantors to corporate debtors. The administrative order includes matters under both sections in the redistribution exercise.

What is the Impact of Mumbai Bench Court VI Suspension on Lawyers And Companies

Lawyers, companies, creditors and other parties with cases pending before Court VI should check the revised court allocation and hearing listings. The transfer of cases is intended to allow proceedings to continue before the remaining courts rather than remain with a court that has temporarily stopped functioning.
