Justice Swarana Kanta Sharma raised the issue during the hearing of a petition concerning an adult woman suffering from cerebral palsy and spastic moderate hemiparesis.

The court noted that the Central Government had already issued guidelines in October 2023 to regulate hysterectomy procedures and prevent misuse.

In October 2023, the Union Ministry of Health and Family Welfare issued guidelines aimed at preventing unnecessary hysterectomies across India.
