New Delhi: The Immigration and Foreigners (Amendment) Rules 2026 have been notified by the Ministry of Home Affairs (MHA), bringing important changes for foreign nationals staying in India. 

The revised rules mainly focus on registration timelines, emergency registration provisions, and a new online appeal mechanism. 

The changes aim to improve immigration compliance, strengthen monitoring, and simplify administrative procedures.

What Has Changed Under the Immigration and Foreigners (Amendment) Rules 2026?

The Ministry of Home Affairs has amended the Immigration and Foreigners Rules, 2025 through a new notification issued in June 2026.

The amendments introduce several procedural changes that directly affect foreigners staying in India.

New Registration Timeline for Foreign Nationals

One of the biggest changes relates to foreign nationals who plan to stay in India beyond the prescribed period.

Earlier Rule

Previously, foreigners were required to complete registration within 14 days after the expiry of the 180-day stay period.

New Rule

Under the amended rules:

  • Foreign nationals intending to stay beyond 180 days must complete registration before the expiry of the 180-day period.
  • Registration can now be completed at any time during the stay before reaching the deadline.
  • The earlier 14-day post-expiry window has been removed.

Why This Change Matters

The government of India believes early registration will:

  • Improve immigration monitoring.
  • Reduce last-minute compliance issues.
  • Enhance national security oversight.
  • Create a more predictable registration process.

Online Appeal System Introduced

For the first time, affected individuals will have access to an online appeal mechanism.

Key Features

  • A person affected by an immigration-related order can file an appeal online.
  • The appeal must be submitted within 30 days of receiving the order.
  • Appeals will be handled by the Commissioner of the Bureau of Immigration.
  • A decision is expected after hearing the concerned party.
  • Cases should generally be resolved within 60 days.

The online system is expected to:

  • Improve transparency.
  • Reduce paperwork.
  • Speed up dispute resolution.
  • Increase accessibility for foreign nationals.

Emergency Registration Provision

The amended rules also clarify that registration beyond the prescribed period will generally not be allowed.

However, exceptions may be considered under:

  • Emergency circumstances.
  • Special situations recognized by authorities.
  • Cases supported by valid reasons and documentation.
